Consumers who received a breach notification letter from Communication Federal Credit Union or whose personal information the data breach potentially exposed may be eligible to claim up to $7,500 or a pro rata cash payment from a class action settlement.

Communication Federal Credit Union agreed to pay $2.9 million to resolve a class action lawsuit alleging it failed to adequately safeguard personal information during a targeted cyberattack. The incident may have exposed sensitive data, including

  • Names
  • Dates of birth
  • Addresses
  • Social Security numbers
  • Driver’s license numbers
  • Bank account details
  • Bank card numbers

Who are the class members?

The class includes:

  • Anyone who received a breach notification letter from Communication Federal Credit Union regarding the incident OR
  • Any U.S. resident whose personal information the data breach potentially affected from Dec. 31, 2023, through Jan. 11, 2024

How much can class members get?

All class members can receive three years of identity theft protection and credit monitoring services from a credit bureau, which includes $1 million in identity theft insurance.

They can also receive one of two cash payment options:

  • Out-of-pocket losses reimbursement: Class members can claim up to $7,500 for documented, out-of-pocket losses related to the data breach. Eligible expenses include fees for credit reports, credit monitoring or freezing or unfreezing credit, costs to replace identification documents or for postage to contact banks, and losses from identity theft or fraud.
  • Pro rata cash payment: Instead of claiming out-of-pocket losses, class members may claim a pro rata share of the net settlement fund. The payment is expected to be about $125, but the actual amount will depend on the number of valid claims.

How to claim a class action payment

Class members can submit the online claim form or download, print and complete the PDF claim form and mail it to the settlement administrator. They can also request a a paper claim form by calling 844-496-1149 or emailing info@CFCUDataIncidentSettlement.com. The claim deadline is Dec. 22, 2025.

Required information

  • For out-of-pocket loss reimbursement, claimants must provide documentation, such as receipts, bank statements or other records showing the amount spent or lost. Self-prepared notes or explanations alone are not sufficient, but class members may submit them as supplemental documentation.
  • For the pro rata cash payment or credit monitoring, claimants need only select the appropriate option on the claim form.
  • To submit an online claim form, class members must log in with the unique ID and PIN from the notice they received. Those who are unable to locate their ID and PIN should contact the settlement administrator by emailing info@CFCUDataIncidentSettlement.com and providing your full name and mailing address.

The settlement administrator will send credit monitoring enrollment codes to the email or physical address provided on the claim form.

$2.9 million settlement fund breakdown

The $2,900,000 settlement fund includes:

  • Settlement administration costs: To be determined
  • Attorneys’ fees: Up to $966,667
  • Attorneys’ expenses: Up to $35,000
  • Service awards to class representatives: Up to $2,500 each
  • Payments to eligible class members: The remainder of the fund

Communication Federal Credit Union will also spend approximately $986,000 over the next five years to implement business practice enhancements, including additional personnel. This cost is separate from the settlement fund.

When is the Communication Federal Credit Union data breach settlement payout date?

The settlement administrator will distribute payments approximately 30 days after it resolves any appeals and the court grants final approval of the settlement.

Why did this class action settlement happen?

The class action lawsuit alleged Communication Federal Credit Union failed to adequately protect personal information, resulting in a cyberattack that exposed sensitive data.

The company denies any wrongdoing, but both sides agreed to settle to avoid the costs, risks and uncertainties of further litigation.
