Why is there a class action settlement?
The class action lawsuit alleged that Zoa Energy LLC mislabeled its energy drinks as containing “0 preservatives” yet the products contained citric and ascorbic acids, which the plaintiffs claimed are used as chemical preservatives. Zoa Energy denied any wrongdoing or liability but agreed to settle to avoid the cost and uncertainty of continued litigation and a possible trial.
Zoa also agreed to adopt new labeling that does not state "0 preservatives" when the product contains chemical preservatives.
