Individuals who worked as a nonexempt classified branch employee for America First Credit Union at any time between Nov. 3, 2022, and July 15, 2025, may be eligible to claim a cash payment from a collective action.

America First Credit Union agreed to pay up to $850,000 to resolve a collective action alleging it violated federal and state wage-and-hour laws, including claims of unpaid wages and overtime compensation.

Who can file a claim?

Individuals who meet the following criteria are eligible to participate in this settlement:

  • They worked for America First Credit Union as a nonexempt classified branch employee (regardless of exact job title).
  • America First employed them at any time between Nov. 3, 2022, and July 15, 2025.
  • America First employed them at any branch location in the United States.

The settlement administrator will determine eligibility based on AFCU’s employment records. If an individual received a notice about this settlement, it is because AFCU’s records show they worked as a branch employee during the covered period.

How much can class members get?

Each eligible class member can receive a monetary payment from the settlement fund. The settlement administrator determines the amount using a formula that allocates the net fund (the total settlement fund after deductions for attorneys fees and costs, settlement administration costs and a service award to the class representative) among all claimants based on the number of weeks they worked as a branch employee during the covered period.

Here’s how the calculation works:

  • Each eligible week worked counts as one point.
  • The settlement administrator adds the total number of points for all claimants to create a denominator.
  • It calculates each claimant’s share as number of weeks worked by claimant / total number of eligible weeks for all claimants × net fund

Half of each payment is subject to payroll taxes. The settlement administrator will report half on a W-2 and the other half on a 1099 as nonwage income.

Any remaining funds will revert to AFCU.

How to claim a settlement payout

Eligible class members must submit a consent to join and release form to participate in the settlement and receive payment. They can file the form online or download and print the PDF form, complete it and mail, email or fax it to the settlement administrator.

The claim deadline is May 11, 2026. Those who do not submit the form by the deadline will not receive a payment from the settlement.

Payout options

The settlement administrator will send checks via First Class U.S. Mail to the address the class member provides on the claim form. If they do not cash the check within 120 days, it will become void, and the funds will revert to AFCU.

$850,000 settlement fund breakdown

The $850,000 settlement fund includes:

  • Service award to named claimant: $10,000
  • Payments to class members: The remainder of the fund (estimated $485,125)

If the total number of eligible workweeks increases by more than 3% above 173,829 (i.e., 179,044 or more), AFCU will add funds proportionally to the settlement.

When is the America First Credit Union settlement payout date?

Why did this collective action settlement happen?

The collective action lawsuit alleged America First Credit Union failed to pay nonexempt branch employees for all hours worked, including overtime, in violation of federal and state wage and hour laws. The lawsuit specifically claimed AFCU did not compensate employees for time spent performing branch opening security procedures and logging into computers before clocking in.

AFCU denied all allegations but agreed to settle to avoid further litigation and expense. The settlement does not constitute an admission of wrongdoing by AFCU.
