
Individuals whose personal information the Varsity Brands data incident potentially exposed may be eligible to claim up to $6,500 plus other benefits from a class action settlement.
Varsity Brands Inc. agreed to pay $1.1 million to settle a class action lawsuit alleging it failed to adequately protect personal information during a cybersecurity incident that occurred on or around May 22, 2024.
Who can file a claim?
The settlement class is defined as all residents of the United States whose private information the Varsity Brands data incident potentially compromised.
If an individual received a notice about this settlement, it means records indicate the breach involved their information. However, even those who did not receive a notice may still be eligible if they meet the above criteria.
How much can class members get?
Out-of-pocket losses: Up to $6,500 per person for documented, unreimbursed losses that are fairly traceable to the data incident. Eligible expenses include:
- Bank fees
- Long-distance phone charges
- Cell phone charges (if charged by the minute)
- Data charges (if charged by the amount of data used)
- Postage
- Gasoline for local travel
- Fees for credit reports, credit monitoring or other identity theft insurance products purchased between May 24, 2024, and April 15, 2026
- Losses resulting from fraud, identity theft or similar victimization
- Cash payment: A pro rata payment estimated at $100 per person
- Credit monitoring: Two years of credit monitoring and identity theft protection at no cost and available to all claimants who submit a valid claim
The settlement administrator may increase or decrease the amount of any monetary payment on a pro rata basis depending on the total amount of approved claims.
How to claim a class action payment
Class members can file a claim online or download, print and complete a PDF claim form (Page 37 of the settlement agreement) to mail to the settlement administrator. The claim deadline is April 15, 2026.

What proof or documentation is required to submit a claim?
- To file a claim online, class members must enter their notice ID and last name.
- To file a claim for the $100 cash payment or credit monitoring, class members only need to complete the claim form.
- To file a claim for reimbursement of out-of-pocket losses, class members must provide documentation showing the amount of their loss and that it is fairly traceable to the data incident. This may include receipts, bank statements or other records.

$1.1 million settlement fund breakdown
The $1,100,000 settlement fund includes:

- Attorneys' fees: Up to $366,666.67
- Attorneys' expenses: Up to $35,000
- Credit monitoring costs: Determined by number of valid claims
- Payments to eligible class members: The remainder of the fund

When is the Varsity Brands Data Breach Settlement payout date?
The settlement administrator will issue payments within 30 days of its approval of the last claim or the court's approval of the settlement, whichever is later. Appeals may delay payments.
Why is there a class action settlement?
The class action settlement alleged Varsity Brands failed to adequately protect personal information during a cybersecurity incident in May 2024. The plaintiffs claimed unauthorized access to Varsity Brands' network exposed sensitive data.
