Participants or beneficiaries in the United Surgical Partners International Inc. 401(k) plan at any time between April 30, 2015, and Dec. 31, 2018, may qualify to claim a share of a class action settlement.

United Surgical Partners International Inc. agreed to pay $1,475,000 to resolve a class action lawsuit alleging violations of federal retirement law. The plaintiffs claimed the company allowed the 401(k) plan to pay excessive recordkeeping and administrative fees and failed to properly monitor the plan’s oversight committee.

Who are the class members?

The class includes anyone who participated in or was a beneficiary of the United Surgical Partners International Inc. 401(k) plan between April 30, 2015 and Dec. 31, 2018.

This includes participants and beneficiaries whose accounts have since merged into the Tenet Healthcare Corporation 401(k) Retirement Savings Plan.

USPI's records identified participants or beneficiaries during the relevant period. Those who received a settlement notice are most likely class members.

How much can class members receive?

Pro rata payment: The total settlement fund is $1,475,000. After deducting court-approved expenses such as attorneys’ fees, administrative costs, taxes and service awards to the class representatives, the settlement administrator will distribute the remaining funds among class members proportional to each class member’s account balance during the class period.

The exact amount each class member receives depends on:

  • The number of eligible class members
  • The amount of money each class member had in the plan during the relevant period

No class member will receive a payment of less than $5; those whose calculated share is $5 or less will not receive a distribution.

No action needed to receive payment

Class members do not need to file a claim to receive their share of the settlement. The settlement administrator will automatically distribute payments to eligible class members based on plan records.

  • Class members who currently have a Tenet plan account will receive their settlement payment deposited directly into that account.
  • Class members who do not have a Tenet plan account at the time of distribution will receive a paper check mailed to their last known address.

$1.5 million settlement fund breakdown

The $1,475,000 settlement fund covers:

  • Administrative costs, taxes and related expenses: To be determined
  • Attorneys’ fees: Up to $491,667
  • Attorneys' expenses: To be determined
  • Service awards to class representatives: Up to $5,000 each for four representatives (up to $20,000 total)
  • Payments to eligible class members: The remainder of the fund
