Roush Fenway Keselowski Racing LLC, also known as RFK Racing, agreed to settle a class action lawsuit alleging it failed to adequately protect personal information during a targeted cyberattack in May 2025. The plaintiffs claim unauthorized parties may have accessed files containing sensitive data, such as names and Social Security numbers.
Who can file a claim?
The settlement class includes individuals whom RFK Racing sent a notice stating the May 2025 data incident may have affected their private information. If an individual received a notification from RFK Racing, most likely sent in September 2025, they are likely a class member and may be eligible for settlement benefits.
How much can class members get?
Class members can choose between:
- Cash Payment A – Documented losses: Up to $2,500 for actual, documented out-of-pocket losses that are fairly traceable to the RFK Racing data incident. To claim this payment, class members must provide documentation, such as receipts, showing the expenses occurred between May 14, 2025, and May 31, 2026, and are related to the data incident. They cannot claim reimbursement for expenses already covered by a third party. Eligible expenses include:
- Losses due to identity theft or fraud
- Fees for credit reports, credit monitoring or freezing/unfreezing credit
- Costs to replace identification documents
- Postage costs for contacting banks by mail
- Cash Payment B – Alternate cash payment: A one-time $90 cash payment. Class members do not need to provide documentation for this option; they must simply attest they are a class member.
Additionally, all class members are eligible for two years of CyEx Identity Defense Complete credit monitoring, which includes:
- Real-time credit file monitoring
- Dark web scanning
- Comprehensive public records monitoring
- $1 million in identity theft insurance
How to claim a class action payment
Class members can submit the online claim form or print and complete a PDF claim form from the settlement website and mail it to the settlement administrator.

What proof or documentation is necessary to submit a claim?
- To log in to the online claim form, class members must provide the unique ID and PIN from the settlement notice the administrator sent them. Those who cannot locate their ID and PIN should contact the settlement administrator by emailing info@RFKRacingDataSettlement.com and providing their full name and mailing address.
- To claim reimbursement for documented losses, class members must provide receipts or other proof of out-of-pocket expenses. Personal certifications, declarations or affidavits are not considered sufficient documentation, but class members can include them to provide context for their claim.
- To claim the alternate cash payment, class members do not need to provide documentation but must select the correct option and attest that they area class member.
