Neutrogena Skin360 $4.7M BIPA Class Action Settlement

Consumers who performed a Skin360 skin assessment using any version of Skin360, including Neutrogena Skin360 or NeoStrata Skin360, while in Illinois between Dec. 9, 2019, and May 5, 2023, may be eligible to submit a claim for a cash payment from a class action settlement.

Johnson & Johnson Consumer Inc., now known as Kenvue Brands LLC, agreed to pay $4.7 million to settle a class action lawsuit alleging violations of Illinois’ Biometric Information Privacy Act. The plaintiffs claim the company collected, stored, disclosed and profited from individuals’ biometric facial geometry through the Skin360 platform without providing required written disclosures or obtaining written consent.

Who can file a claim for a Neutrogena payout?

Class members must meet the following criteria:

  • They performed a Skin360 skin assessment by scanning their face using any version of Skin360, including Neutrogena Skin360 and NeoStrata Skin360.
  • They completed the assessment using a mobile app or website.
  • They completed the assessment in Illinois between Dec. 9, 2019, and May 5, 2023.

How much are settlement payments?

Pro rata cash payment: Class members can submit a claim to receive a pro rata share of the net settlement fund. The settlement administrator will determine the final payment amount by the total number of valid claims submitted.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print and complete the PDF claim form, and mail it to the settlement administrator. The settlement allows only one claim per class member.

Settlement fund breakdown

The $4,700,000 settlement fund will include:

  • Settlement administration costs: To be determined
  • Attorneys’ fees: Up to $1,566,667 plus reasonable costs and expenses
  • Service awards to class representatives: Up to $5,000 each for four representatives ($20,000 total)
  • Payments to eligible claimants: Remaining settlement funds

When is the Johnson & Johnson Skin360 BIPA settlement payout date?

The settlement administrator will issue payments to approved claimants after the court resolves any appeals and grants final approval to the settlement.

Why is there a class action settlement?

The class action lawsuit alleged Johnson & Johnson Consumer Inc., now Kenvue Brands LLC, collected, stored, disclosed and profited from biometric facial data of Illinois users who performed Skin360 skin assessments without providing the required disclosures or obtaining written consent as mandated by Illinois’ Biometric Information Privacy Act.

The company denies the allegations but agreed to settle to avoid the expense and risk of continued litigation and a possible trial. The settlement also requires Kenvue to delete collected images and implement new privacy policies.
