Individuals who requested and paid for copies of certain medical records from Datavant, formerly known as HealthPort Technologies, between July 15, 2005, and Sept. 3, 2012, may be eligible to submit a claim for a cash payment from a class action settlement.
Datavant LLC, formerly known as Healthport Technologies LLC, agreed to pay $5.59 million to settle a class action lawsuit alleging the company overcharged for medical record copies in violation of the Pennsylvania Medical Records Act.
There is a similar settlement for individuals who requested and paid for copies of certain medical records from IOD Inc., now known as Datavant LLC, between the same dates.
Who can file a claim?
Class members are:
- Patients who requested and paid for their own medical records
- Patient representatives or designees, such as insurance companies and attorneys, who requested records on behalf of a patient
- Individuals or entities who made a request or served a subpoena to a Pennsylvania health care provider or facility to obtain copies of medical records even if not designated by a patient
- Individuals or entities whom Healthport, now known as Datavant, or its subsidiaries charged, and who paid the maximum basic, search and retrieval, and/or reproduction fees as set forth in the Pennsylvania Medical Records Act as effective between July 15, 2025, and Sept. 3, 2012
- Individuals or entities who received a mail notice or whom Datavant’s records identify as a class member
How much is the class action rebate?
Cash payment: Eligible class members can submit a claim to receive a cash payment equal to 35% of the amounts they paid to Datavant for basic fees, search and retrieval fees, and/or per page copying fees for each medical record request they made during the relevant period. The total amount each member may claim is listed in the class notice they received.
If the total number of valid claims exceeds the $5,588,547.30 claims payment amount, the settlement administrator will reduce payment amounts on a pro rata basis. If a class member received reimbursement for their payment by someone else, such as a client or insurer, the benefit may need to go to the correct party.
How to claim a class action payment
To receive a payment, class members can submit the online claim form or print and complete the PDF claim form (pages 60-62 of the settlement agreement) and send it to the settlement administrator.

Required proof and documentation
- Class members using the online claim form must provide the notice ID and PIN from the settlement notice they received.
- Beneficiaries or successors must provide supporting documentation, such as a death certificate, estate documentation or marriage license.

When is the Datavant payout date?
The settlement administrator will issue payments to eligible class members after the court resolves any appeals and grants final approval of the settlement.
Why is there a class action settlement?
The class action lawsuit alleged Healthport, now known as Datavant, overcharged for medical record copies by charging the statutory maximum fees rather than the actual and reasonable expenses required by the Pennsylvania Medical Records Act. The plaintiffs claimed this resulted in overpayments by patients, attorneys and others requesting records.
Datavant denied any wrongdoing but agreed to settle to avoid the risk and expense of continued litigation.
