New $117 Million Pork Price-Fixing Class Action Settlement

Consumers who purchased raw pork bacon or certain other raw pork products for personal consumption between June 28, 2014, and June 30, 2018, in select states or the District of Columbia may be eligible to submit a claim for a cash payment from a class action settlement.

Tyson Foods Inc., Clemens Food Group LLC, Hormel Foods Corp., Seaboard Foods LLC, Triumph Foods LLC and Agri Stats Inc. agreed to settle a class action lawsuit alleging they conspired to inflate and stabilize pork prices in violation of antitrust laws. The total settlement fund from these defendants, with the exception of Agri States, is $117.065 million. Agri Stats agreed to nonmonetary reforms but will not provide cash payments.

Two other defendants in the case, JBS and Smithfield, previously settled claims for a total of $95 million. The claims period for those settlements is closed. Class members who wish to participate in the remaining defendants' settlement must submit a new claim.

Who can file a claim for a pork price-fixing settlement payout?

Class members must meet the following criteria:

• They purchased fresh or frozen raw pork bacon or other eligible raw pork products made from bellies, loins, shoulder, ribs and pork chops for personal or household use between June 28, 2014, and June 30, 2018.
• They purchased the pork in one or more of the following states or jurisdictions: Arizona, California, District of Columbia, Florida, Hawaii, Illinois, Iowa, Kansas, Maine, Michigan, Minnesota, Missouri, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Rhode Island, South Carolina, Tennessee, Utah, or West Virginia
• They purchased the pork from a grocery store, supermarket or other meat retailer, which is known as an indirect purchase.

Class members can search eligible pork products online or view the PDF product eligibility list on the settlement website.

Are there any exclusions?

The settlement does not include pork marketed as organic or no-antibiotics ever or any pork product other than bacon that is marinated, seasoned, flavored or breaded.

How much are settlement payments?

Pro rata cash payment: Class members can submit a claim to receive a pro rata cash payment from the net settlement fund. The settlement administrator will determine the final payment amount by the total number of eligible pork products purchased and number of claims filed.

To receive a settlement payment, class members can file a claim online or print and complete the PDF claim form and mail it to the settlement administrator

Required claim information

Class members must include the following information on the claim form:

• Whether the claim is for an individual or a business
• Their best estimate of the total pounds of eligible pork they purchased during the class period
• Their best estimate of the total number of months during the class period that they purchased eligible pork products
• Their best estimate of the amount spent on eligible pork products per month during the class period

The claim form does not require proof of purchases; however, the settlement administrator may request additional information or documentation at a later date.

When is the indirect purchaser pork price-fixing settlement payout date?

The settlement administrator will issue payments to approved claimants after the court resolves any appeals and grants final approval of the settlement.

Why did this class action settlement happen?

This class action lawsuit, known as In re Pork Antitrust Litigation, alleged several major pork processors conspired to inflate and stabilize the price and supply of pork products through the use of Agri Stats, production restraints and export strategies.

The companies deny all allegations of wrongdoing but agreed to settle to avoid the expense and risk of further litigation and a possible trial.
