Consumers who received a text message from Posh Group Inc. after asking it to stop may qualify to claim up to $52.94 per message from a class action settlement.

Posh Group agreed to pay up to $900,000 to settle a class action lawsuit alleging it sent marketing text messages to individuals after they requested to not receive further messages. The lawsuit claimed this conduct violated the Telephone Consumer Protection Act.

Who is eligible to file a Posh Group claim?

Class members must meet the following criteria:

  • They received a text message from Posh Group Inc. or anyone acting on its behalf.
    • The message was about Posh Group Inc.’s goods, products or services.
    • The message was sent to the person’s residential telephone number.
    • The person had previously requested Posh Group Inc. stop sending text messages.
    • The message was sent within the four years prior to the filing of the complaint (between Feb. 12, 2021, and the present)

How much is the TCPA payout?

Each eligible class member who submits a valid claim can receive up to $52.94 for every qualifying text message received after they requested that Posh Group Inc. stop sending messages. The total settlement fund is capped at $900,000, which also covers administrative costs, attorneys’ fees and expenses and a service award to the class representative.

The actual payment amount per claimant may be less than $52.94 per message, depending on the number of valid claims submitted and the deductions for fees and costs from the settlement fund.

How to claim a class action rebate

Class members can file a claim online or download, print, complete and mail a PDF claim form to the settlement administrator. Completed claim forms must be postmarked or submitted online by Sept. 9, 2025.

Only one claim is allowed per class member.

What information is necessary to submit a claim?

  • All class members must provide the class member ID located in their email or postcard settlement notice. Online claimants must also provide the PIN from the same notice.
  • Class members must provide the phone number that received the text message(s).

Payout options

Payments will be made by paper check and mailed to the address provided on the claim form.

$900,000 settlement fund breakdown

The $900,000 settlement fund covers:

  • Settlement administration costs: To be determined
  • Attorneys’ fees and expenses: Up to $360,000
  • Service award to class representative: Up to $7,500
  • Payments to eligible class members: Remainder of the fund

Important dates

  • Deadline to opt out: Aug. 5, 2025
  • Final approval (fairness) hearing: Aug. 25, 2025
  • Deadline to file a claim: Sept. 9, 2025

When is the Posh text message settlement payout date?

Payments to class members will be issued approximately 60 days after the settlement receives final court approval and any appeals are resolved.
