Consumers residing in the United States whose personal information was or may have been accessed or acquired in the NorthCare data incident, may qualify to submit a claim for credit monitoring and up to a $2,000 cash payment from a class action settlement.

North Oklahoma County Mental Health Center, d/b/a NorthCare, has agreed to pay to settle a class action lawsuit alleging that the company failed to adequately protect the personal and health information of its clients following a data breach that occurred on or about May 29, 2021. The lawsuit claims that unauthorized individuals accessed or acquired sensitive information from NorthCare’s computer servers.

Who is eligible for a data breach payout?

Class members are individuals residing in the United States whose personally identifiable information (PII) and protected health information (PHI) was or may have been accessed or acquired in the NorthCare data incident that occurred on or about May 29, 2021.

How much is the class action settlement payment?

Class members may claim one or more of the following benefits:

  • Reimbursement for out-of-pocket or financial losses: Claimants can submit for up to $2,000 per person for documented losses that are fairly traceable to the data incident. Expenses may include fees for credit report access, freezing or unfreezing credit and credit monitoring, and unreimbursed costs due to identity theft or fraud.
  • Reimbursement for time spent: Class members may claim up to five hours at $20 per hour for time spent dealing with the data breach. The maximum payment is $100.
  • Credit monitoring services: Class members may submit to receive three years of one-bureau credit monitoring, which includes access to credit reports and identity theft insurance.
  • Alternative cash payment: Class members that do not submit for out-of-pocket or financial losses, time lost or credit monitoring claims may submit to receive a flat alternative payment of $125.

How to claim a class action rebate

To receive a settlement payment, class members must submit a claim by Oct. 11, 2025. Individuals can submit the online claim form or print the PDF claim form(FS)%20-%20FINAL.pdf) to mail to the settlement administrator.

Required claim information and proof

  • Class Member ID from settlement notice required on claim form, if available.
  • Reimbursement of out-of-pocket or financial losses claims require supporting documentation which may include receipts, invoices, bank or credit card statements showing unreimbursed fees or fraudulent charges, police report or other proof of fraud or identity theft.

  • PayPal
  • Venmo
  • Zelle
  • Virtual prepaid card

Data breach settlement fund

The settlement fund will include:

  • Settlement administration costs: To be determined
  • Attorneys’ fees, costs, and expenses: Up to $250,000
  • Service awards to class representatives: Up to $2,000 each
  • Credit monitoring costs: Determined by the number of claims filed
  • Payments to approved claimants: Total determined by the number of valid claims filed

  • Exclusion deadline: Sept. 12, 2025
  • Deadline to file a claim: Oct. 11, 2025
  • Final fairness hearing: Dec. 15, 2025, at 10:00 a.m. CST

When is the NorthCare data breach settlement payout date?

Payments to valid claimants will be issued approximately 60 days after the settlement is granted final approval.

Why did this class action lawsuit and settlement happen?

The class action lawsuit was filed after a data incident on or about May 29, 2021, in which unauthorized parties accessed or acquired personal and health information from NorthCare’s computer servers. Plaintiffs alleged that NorthCare failed to adequately protect this information.

NorthCare denies these allegations but agreed to settle to avoid the cost and risk of further litigation, including the possibility of a trial.
