
Individuals who received a notice from Mystic Valley Elder Services Inc. in or around October 2024 stating a data breach may have compromised their personal information could be eligible to claim up to $5,000 plus a pro rata payment and credit monitoring from a class action settlement.
Mystic Valley Elder Services Inc. agreed to pay $520,000 to settle a class action lawsuit alleging it failed to protect personal information during a cybersecurity incident that occurred on or around April 5, 2024.
Who can file a claim?
Class members are eligible to file a claim if they received a written notice from Mystic Valley Elder Services Inc. on or around Oct. 22, 2024, informing them the data breach involved their personal information.
How much can class members get?
- Out-of-pocket expense reimbursement: Up to $5,000 per person for documented, unreimbursed expenses fairly traceable to the data incident. Eligible expenses include:
- Bank fees
- Postage
- Gasoline for local travel
- Fees for credit reports, credit monitoring or identity theft insurance purchased between April 5, 2024, and Feb. 9, 2026
- Losses resulting from fraud, identity theft or similar victimization
- Pro rata cash payment: An estimated $75 per person available to all class members who submit a valid claim form
- Credit monitoring and identity theft protection: Two years of complimentary credit monitoring and identity theft protection services available to all class members who submit a valid claim form
The settlement administrator may increase or decrease the pro rata cash payment depending on the total number of approved claims. If class members submit fewer claims, each claimant may receive more than $75; if class members submit more claims, each claimant may receive less than $75.
How to claim a class action payment
Eligible class members can submit the online claim form or download, print and complete the PDF claim form (Page 43 of the settlement agreement) and mail it to the settlement administrator.

When is the Mystic Valley Elder Services data breach payout date?
The settlement administrator will issue payments to eligible class members approximately 30 days after the court resolves any appeals or grants final approval to the settlement, whichever is later.
Why is there a class action settlement?
This class action lawsuit alleged a cybersecurity incident that occurred on or around April 5, 2024, allowed unauthorized parties to access Mystic Valley Elder Services Inc. files containing personal information. The plaintiffs claimed the company failed to adequately protect this information.
Mystic Valley Elder Services Inc. denies any wrongdoing or liability but agreed to settle to avoid the expense, delay and uncertainty of continued litigation.
