
Individuals who lived, worked owned property or were otherwise affected by the August 2023 Maui wildfires may qualify to claim a cash payment from a class action settlement.
Hawaiian Electric Co. Inc., along with the State of Hawaii, County of Maui, Kamehameha Schools, Spectrum Oceanic LLC, Hawaiian Telcom Inc., the West Maui Land Co. and certain affiliates agreed to pay $4.04 billion to settle a class action lawsuit alleging they are responsible for damages the August 2023 Maui wildfires caused.
Who can file a claim?
Class members must meet one of the following criteria:
- They owned, rented or resided on real property or owned personal property within the fire perimeters or within 0.5 miles of the fire perimeters as of Aug. 8, 2023.
- They owned, operated or worked for a business within the fire perimeters or within 0.5 miles of the fire perimeters between Aug. 8 and Oct. 8, 2023.
- They were present within the fire perimeters or within five miles of those perimeters between Aug. 8, 2023, and 9 a.m. on Aug. 9, 2023.
- They suffered physical injury due to the fires or are an eligible relative of such a person.
- They are a personal representative or eligible relative of someone who died as a result of the fires.
- They are an immediate family member of a person present within the fire perimeters on Aug. 8, 2023.
- They purchased a ticket before Aug. 8, 2023, for travel by plane or ship to Maui between Aug. 8 and Oct. 8, 2023, and suffered unreimbursed economic loss due to cancellation or delay.
- They fires caused them property damage on Maui between Aug. 8 and Oct. 8, 2023.
- They owned or operated a business on Maui that suffered losses from a decline in tourism between Aug. 8 and Oct. 8, 2023.
Eligible relatives and/or immediate family members include a surviving spouse, reciprocal beneficiary, child, parent, grandparent, grandchild, stepparent, stepchild, stepsibling or equivalent adoptive relationship.
Who is excluded from the class?
- Insurers and insurance syndicates with subrogation or reimbursement rights (except in specific cases where they submit on behalf of a policyholder)
- Those who execute an individual settlement agreement and release before Oct. 7, 2025, to participate in the individual settlement fund
Individuals who hired their own attorney for a wildfire-related claim should consult with their lawyer about opting out of the class settlement fund and pursuing compensation through the individual settlement fund.
How much can class members get?
The class settlement fund totals $135 million, and the settlement administrator will distribute it among eligible claimants based on the number of valid claims and the allocation formula, which will be posted on the official settlement website after court approval.
Class members can claim for multiple types of losses, including:
- Real property loss
- Personal property loss
- Business interruption
- Personal income loss
- Evacuation expenses
- Physical injury
- Wrongful death
- Travel losses
- Damage to property on Maui
Because the fund must cover all valid claims, as well as attorney fees, service awards and administrative costs, the final payment to each class member may be prorated. This means that if the total value of approved claims exceeds the available fund after fees and costs, the settlement adminstrator will reduce each claimant’s payment proportionally.
How to claim a class action rebate
Class members can file a claim online or download, print and complete a PDF claim form and mail it to the settlement administrator. The claim deadline is Dec. 22, 2025.

Is proof or documentation required to submit a claim?
- To file an online claim, class members must create an account using a valid email address.
- All claimants must provide:
- Their Social Security or taxpayer identification number
- The address and value of their damaged or destroyed real property
- All claimants must provide documentation to support their eligibility and the losses claimed. This may include:
- Proof of residence, property ownership or business operation within the eligible areas
- Documentation of losses, such as repair bills, receipts, business records or medical records for injury claims
- Travel documentation and evidence of unreimbursed losses for travel claims
The settlement administrator may request additional documentation to verify claims.
$4.04 billion settlement fund breakdown
The $4,037,000,000 settlement fund includes $135,000,000 for class members who have not hired their own attorney. The remainder is allocated to the individual settlement fund for those represented by private counsel.

Why is there a class action settlement?
The class action lawsuit alleged the defendants are responsible for the August 2023 Maui wildfires and the resulting damages.
The defendants deny any wrongdoing, but both sides agreed to settle to avoid the costs, risks and uncertainties of continued litigation.
