Vehicle owners or drivers who paid to have a boot installed by Empire Parking Services Inc. removed from a vehicle in the cities of Atlanta, Sandy Springs or Decatur or the counties of Cobb, DeKalb or Fulton between Feb. 3, 2012, and Dec. 12, 2018, may be eligible to submit a claim for up to $30 from a class action settlement.

Empire Parking Services Inc. agreed to pay $4.5 million to settle a class action lawsuit alleging it unlawfully booted vehicles in certain Georgia cities and counties.

Who is eligible for a settlement payment?

Class members are vehicle owners or drivers who paid to have a boot removed from a vehicle booted by Empire Parking Services Inc.

  • The booting must have occurred in the cities of Atlanta, Sandy Springs or Decatur or the counties of Cobb, DeKalb or Fulton
  • The booting must have taken place between Feb. 3, 2012, and Dec. 12, 2018.
  • The vehicle was booted at a noncompliant lot before it became compliant.
  • The claimant was driving the vehicle at the time and personally paid the booting fee.

How much is the class action payout?

Pro rata cash payment: Eligible class members can receive up to $30 per claim. The final payment amount will be determined by the number of valid claims filed.

Class members that received multiple settlement notices or had a vehicle or vehicles booted multiple times are eligible to receive multiple payments. A separate claim form is required for each booting instance.

How to claim a parking class action rebate

Individuals can submit an online claim or complete and mail in the claim form included with the official settlement notice. All claims must be submitted or mailed by the Oct. 23, 2025, deadline.

Required proof and claim information

  • Address or parking lot where booting occurred
  • Date of booting
  • License plate number of booted vehicle
  • Amount paid to Empire Parking Services for boot removal
  • Any documentation showing:
    • Proof that EPS booted the vehicle
    • Evidence that the claimant was driving the vehicle at the time
    • Proof of payment to EPS for boot removal, such as receipts or redacted credit card or bank statements

Payout options

Approved claimants will receive a check mailed to the address provided.

$4.5 million settlement fund

The $4,500,000 settlement fund includes:

  • Settlement administration costs: Up to $300,000
  • Attorneys’ fees and expenses: Up to $1,575,000
  • Service awards to class representatives: $10,000 each ($50,000 total)
  • Payments to approved claimants: Remaining settlement funds

  • Exclusion deadline: Sept. 2, 2025
  • Fairness hearing: Sept. 30, 2025
  • Deadline to file a claim: Oct. 23, 2025

When is the Empire Parking Services settlement payout date?

Payments will be mailed to valid claimants 75 days after the court grants final approval of the settlement or when claim processing is complete, whichever is later.

Why is there a class action lawsuit and settlement?

Multiple class action lawsuits alleged Empire Parking Services Inc. unlawfully booted vehicles in the cities of Atlanta, Sandy Springs or Decatur or the counties of Cobb, DeKalb and Fulton. The plaintiffs claimed EPS’s booting practices were not compliant with local laws.

EPS denied any wrongdoing but agreed to settle to avoid the cost and uncertainty of continued litigation and the possibility of a trial.
