Individuals whom Disability Rights Wisconsin notified of a data breach that occurred in October 2023 may be eligible to claim up to $2,085 from a class action settlement.

Disability Rights Wisconsin Inc. agreed to settle a class action lawsuit alleging a cybersecurity incident exposed the sensitive information of thousands of individuals.

Who can file a claim?

The settlement class includes all individuals who meet the following criteria:

  • They reside in the United States.
  • The data breach Disability Rights Wisconsin discovered in or around October 2023 affected their private or personal information.
  • Disability Rights Wisconsin notified them that the breach may have impacted their information.

Individuals who did not receive a mailed notice but believe they are a class member should contact the settlement administrator.

How much can class members get?

  • Attestation losses: Class members can claim reimbursement for time spent addressing issues the data breach caused. The reimbursement rate is $21.25 per hour up to a maximum of four hours for a total possible payment of $85.
  • Extraordinary expenses: Up to $2,000 for documented out-of-pocket extraordinary expenses related to the incident. Eligible expenses include:
    • Monetary losses from fraud or identity theft
    • Professional fees (such as attorneys, accountants or credit repair services)
    • Costs to freeze or unfreeze credit with a credit reporting agency
    • Credit monitoring costs incurred after notice of the data incident (beyond what is offered by the settlement)
    • Miscellaneous expenses, such as notary, fax, postage, copying, mileage and long-distance telephone charges
  • Credit monitoring: Two years of single-bureau credit monitoring with at least $1 million in identity theft protection and fraud insurance. No documentation is required for this benefit, but class members must request it on the claim form.

How to claim a settlement payment

Class members can file the online claim form or download, print, complete and mail the PDF claim form. The clai, deadline is April 15, 2026.
