Individuals who received a notice from The Cornwell Quality Tools Co. that their personal information may have been affected by a 2022 data breach, may qualify to submit a claim for up to $5,000 from a class action settlement.

Cornwell Quality Tools Co. has agreed to pay to settle a class action lawsuit alleging that the company failed to adequately protect customer and employee data, resulting in a data incident on Sept. 22, 2022.

Who is eligible for a data breach payout?

Class members must meet the following criteria:

  • They are an in the United States whose personal identifying information (PII) was involved in the Cornwell Quality Tools data breach that occurred on Sept. 22, 2022.
  • They were sent a notice of the data incident by Cornwell Quality Tools.

According to the settlement agreement, notice of the data incident was sent to approximately 11,884 individuals.

How much is the data breach payout?

Claims can submit to receive one or more of the following benefits:

  • Ordinary out-of-pocket losses: Class members can submit for reimbursement of up to $500 in losses and expenses related to the data breach.
    • This includes bank fees, fees for credit report copies and credit monitoring services costs.
  • Time spent: Class members can claim up to three hours of time spent addressing the Cornwell data incident, at $20 an hour for a total of $60. This is included in the $500 cap for ordinary out-of-pocket losses.
  • Extraordinary out-of-pocket losses: Class members can submit to receive up to $5,000 reimbursement for documented unreimbursed monetary losses due to identity theft and fraud cased by the Cornwell data breach.
    • This includes fraudulent charges on financial accounts, unauthorized loans and tax fraud.
  • Alternative cash payment: Class members that do not claim ordinary out-of-pocket losses, time spent or extraordinary out-of-pocket losses can submit to receive an alternate cash payment of $50.00.
  • Credit monitoring: All class members can submit to receive two years of three-bureau credit monitoring and fraud protection services, which includes $1 million insurance protection.

How to claim a class action rebate

To receive a settlement payment, a claim form must be submitted by Nov. 27, 2025. Class members can submit in one of two ways:

Required proof and claim information

  • Unique ID and PIN from settlement notice required to submit an online claim.
  • Ordinary out-of-pocket losses claims require supporting documentation such as bank statements, receipts or invoices for services.
  • Extraordinary out-of-pocket claims require proof such as police report, invoices for CPA or attorney services retained due to identity theft and tax fraud and documentation showing fraudulent charges or unauthorized loans.

Settlement fund breakdown

The settlement fund will include:

  • Settlement administration costs: To be determined

  • Service awards to class representatives: $2,000 each, total $4,000
  • Credit monitoring services: Cost determined by the number of valid claims filed
  • Payments to claimants: Total determined by number and type of approved claims

When is the Cornwell Quality Tools Co. data breach settlement payout date?

Payments will be issued to approved claimants approximately 95 days after the court grants final approval of the settlement.

Why did this class action settlement happen?

This class action lawsuit was filed after an unauthorized third party accessed The Cornwell Quality Tools Co.’s computer systems on Sept. 22, 2022, exposing certain personal identifying information. Plaintiffs alleged that the company was negligent in its data security practices.

Cornwell Quality Tools denies these allegations but agreed to settle to avoid the expense and uncertainty of continuing litigation.

What happens next?

The court will hold a final approval hearing on Nov. 19, 2025. If the settlement is approved and no appeals delay the process, payments and benefits will be distributed to eligible claimants who submitted valid claims by the deadline.
