Who is eligible to file a data breach claim?
Class members should have received a mailed notice from the settlement administrator. There are two groups of class members:
- Non-SSN Class Members: This class includes approximately 541,870 individuals in the United States and includes those who had their personal information, but not Social Security Numbers, exposed during the data breach.
- SSN Class Members: This class includes approximately 55,131 individuals who had their personal information, including Social Security Numbers, compromised in the breach.
How much is the WellNow settlement payout?
The amount eligible class members can claim depends on their member status and the type of losses they experienced.
- Non-SSN Class Members:
- _Extraordinary Out-of-Pocket Expense Claims_: These class members can claim up to $7,500 for actual, documented and unreimbursed expenses directly related to the data breach.
- _Lost-Time Claims_: Non-SSN class members can claim up to two hours of lost time at $25 per hour for a maximum of $50 for time spent addressing the data breach.
- SSN Class Members:
- _Pro Rata Cash Payment_: SSN class members that do not submit for reimbursement for extraordinary out-of-pocket losses and lost time, can submit a pro rata cash payment, amount to be determined by the number of valid claims filed.
- _Extraordinary Out-of-Pocket Expense Claims_: These class members can claim up to $7,500 for actual, documented and unreimbursed expenses traceable to the breach.
- _Lost-Time Claims_: These class members can claim up to three hours of lost time at $25 per hour for a maximum of $75 for time spent dealing with issues related to the breach.
