
Consumers who purchased a Bestway above-ground pool between 2008 and 2024 that is 48 inches or taller with compression straps running on the outside of the vertical support legs may be eligible to claim a cash payment from a class action settlement.
Bestway (USA) Inc., Bestway Inflatables & Material Corp. and Bestway (Hong Kong) International Ltd. agreed to pay $15 million to settle a class action lawsuit alleging some of its above-ground pool models have a safety defect that could pose a drowning risk.
Who can file a claim?
Class members must meet all of the following criteria:
- They purchased a Bestway-branded above-ground pool that is 48 inches or taller in height.
- The pool must have compression straps located outside of the support poles.
- They purchased the pool before May 4, 2026.
- They purchased the pool in the United States, its territories or the District of Columbia.
- The purchased the pool for personal use and not for resale.
- They purchased the pool new from a retailer and not secondhand.
- Eligible pool brands include Power Steel, Steel Pro and Coleman Power Steel models.
Only one claim is allowed per household, which the settlement defines as all persons sharing the same residential address.
How much can class members get?
Class members who submit a valid and timely claim may receive a cash payment. The amount depends on whether the class member provides valid proof of purchase:
- With valid proof of purchase: Class members can receive 10% of either the actual price paid (as shown on the receipt) or the average retail price (if the proof of purchase does not show the actual price).
- Without valid proof of purchase: Class members will receive a flat payment of $40.
The settlement administrator may reduce payments if the total claims exceed the available settlement fund after deductions for attorneys’ fee and costs, administration costs and service awards.

What proof or documentation is required to submit a claim?
Claimants must provide valid proof of purchase to receive 10% of the purchase price or average retail price. Acceptable proof includes store receipts, online purchase receipts or other objectively verifiable records showing purchase of a class product before May 4, 2026. If the class member does not provide proof, they will receive $40.
