
Individuals whom VisionPoint Eye Center notified that an October 2024 data breach may have impacted their personal or health information could be eligible to claim up to $2,500 from a class action settlement.
VisionPoint Eye Center PLLC agreed to pay $750,000 to resolve a class action lawsuit alleging it failed to prevent a data breach that exposed sensitive personal and health information.
Who can file a claim?
Class members must meet the following criteria:
- They are an individual whose personally identifiable information or personal health information the October 2024 data breach involving VisionPoint Eye Center potentially compromised.
- They received a notice from VisionPoint Eye Center regarding the data incident.
How much can class members get?
Class members may be eligible for the following benefits:
- Expense reimbursement: Up to $2,500 for documented, unreimbursed out-of-pocket expenses that are fairly traceable to the data breach. Class members must provide supporting documentation to qualify.
- Examples of out-of-pocket expenses include unreimbursed costs to obtain credit reports, credit freeze fees, card replacement fees, bank or credit card fees, postage, mileage, other incidental expenses and costs associated with up to one year of credit monitoring or identity theft insurance purchased after Oct. 4, 2024, and before the settlement effective date.
- Alternative cash payment: An estimated flat cash payment of $45. The settlement administrator will determine the final amount by the total number of valid claims and the funds remaining after it pays other settlement expenses.
- Credit monitoring: Two years of one bureau credit monitoring. Class members may claim this benefit in addition to either expense reimbursement or the alternative cash payment.
The settlement administrator will distribute the fund in the following order: settlement administration costs, attorneys’ fees and expenses, service awards to class representatives and then payments and credit monitoring benefits to class members.
If the number of valid claims exceeds the available funds, the settlement administrator will reduce all payments on a pro rata basis.
How to claim a VisionPoint Eye Center data breach payment
Class members can submit the online claim form or download, print and complete the PDF claim form and mail it to the settlement administrator. The claim deadline is March 3, 2026.

Proof or documentation required to submit a claim
- For online or mailed claims, claimants must provide the unique ID from the notice they received, as well as their contact information.
- For out-of-pocket expense reimbursement, claimants must provide reasonable documentation of actual, unreimbursed losses that are fairly traceable to the data breach. Self-prepared documents alone are not sufficient.
- For the alternative cash payment and credit monitoring, claimants do not need to submit documentation. They must select the appropriate option on the claim form.
