AbleTo Prerecorded Voicemail Class Action Settlement

Current and former Aetna members who received a prerecorded voicemail from AbleTo on their cell phone between Sept. 29, 2019, and Feb. 3, 2026, may qualify to submit a claim for $23 from a class action settlement.

AbleTo Inc. agreed to settle a class action lawsuit alleging it sent prerecorded voicemails to mobile phone numbers belonging to Aetna members without obtaining prior express written consent from recipients. The plaintiff claims this conduct violated the Telephone Consumer Protection Act and the Florida Telephone Solicitations Act.

Who can file a claim for a TCPA payout?

Class members must meet the following criteria:

• They are current or former Aetna members residing in the United States.
• They received a prerecorded voicemail from AbleTo on their cellular telephone between Sept. 29, 2019, and Feb. 3, 2026.

How much will settlement payments be?

Pro rata cash payment: Class members can submit a claim to receive a $23 cash payment.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print a PDF claim form from the same link to complete and mail to the settlement administrator. They may also request a claim form by calling or emailing the settlement administrator.

TCPA settlement fund breakdown

The settlement fund will include:

• Settlement administration costs: Up to $535,000
• Attorneys’ fees and expenses: Up to $1,625,000
• Payments to approved claimants: $23 per valid claim

When is the AbleTo TCPA settlement payout date?

The settlement administrator will issue payments to approved claimants approximately 56 days after the court grants final approval of the settlement.

Why did this class action settlement happen?

The class action lawsuit alleged AbleTo Inc. sent prerecorded voicemails to Aetna members’ cell phones without obtaining prior express written consent, which may have violated the TCPA and FTSA.

AbleTo denied all wrongdoing and liability but agreed to settle to avoid the expense, delay and uncertainty of continued litigation or a possible trial.
