Individuals who received more than one text message from US Mortgage Lenders between Jan. 21, 2021, and July 17, 2025, after opting out, may be eligible to submit a claim for up to $400 per message from a class action settlement.

US Mortgage Lenders LLC has agreed to pay up to $244,800 to settle a lawsuit alleging that it sent telemarketing text messages to individuals after they had opted out, in violation of federal and Florida law.

Who can file a claim?

Class members must meet the following criteria:

  • They were residing in the United States and received more than one text message from US Mortgage Lenders within any 12-month period between Jan. 21, 2021, and July 17, 2025.
  • The messages promoted US Mortgage Lenders products or services.
  • They had previously opted out of receiving such messages.

How much is the TCPA settlement payout?

Cash payment: Class members can submit a claim to receive up to $400 for each text message they received after opting out. Final payment amount will be determined by the number of valid claims filed.

How to claim a class action rebate

To receive a settlement payment, class members must file a claim online or download and print the PDF claim form and mail it to the settlement administrator.

$244,800 TCPA settlement fund

The settlement fund will include:

  • Settlement administration costs: To be determined
  • Attorneys’ fees and costs: Not to exceed $73,440
  • Service award to the class representative: Up to $5,000
  • Payments to eligible class members: Remaining settlement funds

When is the US Mortgage Lenders TCPA settlement payout date?

Payments will be issued to approved claimants approximately 75 days after the court grants final approval of the settlement.

Why did this class action settlement happen?

This class action lawsuit was filed because US Mortgage Lenders LLC allegedly sent telemarketing text messages to individuals after they opted out, violating the Telephone Consumer Protection Act (TCPA) and the Florida Telephone Solicitation Act (FTSA). US Mortgage Lenders LLC denies the allegations, but both sides agreed to settle to avoid the expense and uncertainty of continued litigation.
