FTC issuing Pyrex settlement payments over "made in USA" claims

Individuals who purchased Pyrex glass measuring cups on Amazon.com that the company advertised as made in the United States when it actually imported them from China may receive a refund payment from a settlement. The FTC is issuing PayPal payments to qualifying consumers who did not cash their settlement check.

In 2024, Instant Brands LLC, the manufacturer of Pyrex-brand kitchen and home products, agreed to pay $129,416 to settle a class action lawsuit. The FTC lawsuit alleged Instant Brands falsely advertised certain Pyrex glass measuring cups as made in the United States when, during a period of high demand, sit manufactured some of these products in China and sold them to U.S. consumers.

According to the 2023 complaint, the FTC alleged that Instant Brands sold more than 110,000 Pyrex measuring cup sets it manufactured in China but advertised as "made in USA." During the COVID-19 pandemic, the company said it could not meet demand.

In October 2024, the FTC initially sent checks totaling more than $88,000 to 10,259 consumers.

Who qualifies for a Pyrex settlement payout?

Individuals must meet the following criteria:

  • They purchased Pyrex glass measuring cups on Amazon.com between March 2021 and May 2022.
  • They received measuring cups labeled “made in China” that Pyrex advertised online as “made in USA.”
  • They did not receive or cash an FTC settlement check initially mailed in October 2024.

How much will FTC settlement payments be?

Cash payment: Qualifying consumers will receive a cash payment. The settlement administrator will determine the final amount by the cost and number of products they purchased from Amazon.

No claim form required

Eligible consumers did not need to submit a claim to receive a settlement payment. The settlement administrator used Amazon purchase records to identify qualifying individuals.

Payout options

The settlement administrator is issuing PayPal payments using the email address on file with Amazon to qualified consumers who did not cash their initial checks.

Why did this false advertising settlement happen?

The class action lawsuit alleged Instant Brands LLC falsely advertised certain Pyrex glass measuring cups as “made in USA” when it actually manufactured some in China. During the COVID-19 pandemic, demand for Pyrex measuring cups increased, and Instant Brands said it could not meet this demand with U.S.-made products alone.

The company imported some measuring cups from China but continued to market them as made in the United States both in product listings and in broader advertising that emphasized the brand’s “made in the USA heritage.” The FTC order prohibits Instant Brands from making unqualified "made in the USA" claims unless it can substantiate them and requires additional disclosures for certain product components and assembly.
