Why is there a class action settlement?
This class action lawsuit alleged that certain Lotrimin and Tinactin spray products contained benzene, a potentially harmful chemical. The lawsuit claimed that Bayer and other defendants violated state laws and consumer protection statutes through the sale, labeling, marketing and manufacturing of these products.
Bayer and the defendants deny any wrongdoing but agreed to settle to avoid the expense and uncertainty of further litigation and a possible trial.
