Individuals who own a home built by Trinity Homebuilders LLC or Homewood Corp. in specific Ohio counties may be eligible to claim a cash payment from a class action settlement.

Trinity Homebuilders LLC and Homewood Corp. agreed to pay $1,200,000 to settle class action lawsuits alleging the companies constructed homes with underventilated attics, resulting in property damage.

Who can file a claim?

The settlement covers two distinct groups:

  • Trinity Homebuilders LLC class members include current owners of homes Trinity built and sold between Jan. 1, 2009, and March 7, 2018.
    • The home must be located in Franklin, Licking, Delaware, Fairfield or Union counties in Ohio.
    • If another builder originally built the home, Trinity must not have acquired the home through its buy-back program.
  • Homewood Corp. class members include current owners of homes Homewood built between Jan. 1, 1999, and March 7, 2018
    • The home must be located in Franklin, Licking, Delaware, Fairfield or Union counties in Ohio.
    • The home must not have had its original roof replaced.
    • The home must not have been transferred through a foreclosure proceeding.
    • If another builder originally build the home, Homewood must not have acquired it through its buy-back program.

If an individual received a notice in the mail, the settlement administrator believes they may own a qualifying home. Estates of deceased homeowners may also be eligible if they notify the administrator and obtain probate approval. Those who are a current resident but not the owner should forward the notice to the owner or inform the administrator of the current owner's information.

Class members who are in the process of selling their home should notify the settlement administrator of the new owner's name and closing date as this will determine who is entitled to payment.

How much can class members receive?

Class members who submit valid claims will receive a pro rata share of the $1,200,000 settlement fund after deductions for attorneys' fees, costs, incentive awards and administration expenses. The exact amount each class member will receive depends on the total number of valid claims submitted.

  • The maximum payment per class member is capped at $25,000
  • If the total amount to be distributed to class members exceeds the remaining settlement fund, the settlement administrator will reduce each claimant's award proportionally.
  • The settlement administrator will send any remaining funds after all payments (for example, from uncashed checks) to the State of Ohio's unclaimed funds section.

How to claim a settlement payout

Class members can complete the online claim form. There is no PDF claim form. The claim deadline is Feb. 16, 2026.

Information required to submit a claim

  • To file a claim, class members must provide the notice ID and PIN from the settlement notice they received.
    • Homewood class members must also confirm that the original roof has not been replaced and the home was not acquired via foreclosure.
    • Those selling their home should notify the administrator of the new owner's name and closing date as this will determine who is entitled to payment.
    • Those who are an estate representative for a deceased class member must provide a death certificate and documentation proving they are the legal beneficiary.
    • Those who need to update their address or other information after submitting a claim should contact the administrator using the contact details above.

Payout options

The settlement administrator will mail payments by check to the address provided on the claim form. Checks will be valid for 180 days from the date of issuance.

$1.2 million settlement fund breakdown

The $1,200,000 settlement fund covers:

  • Settlement administration costs: To be determined
  • Attorneys' fees: Up to $400,000
  • Attorneys' costs and expenses: Up to $30,000
  • Service awards to class representatives: Up to $25,000 per couple ($50,000 total)
  • Payments to eligible class members: The remainder of the fund

When is the Trinity Homebuilders and Homewood Corp. settlement payout date?

The settlement administrator will mail payments to eligible class members within 45 days after the court resolves any appeals and grants final approval to the settlement.

Why is there a class action settlement?

The class action lawsuits alleged that Trinity Homebuilders LLC and Homewood Corp. constructed homes with underventilated attics, resulting in property damage. The plaintiffs claimed this was a breach of contract, negligence and violation of home construction laws.

The defendants denied all allegations and any liability but agreed to settle to avoid the uncertainty, expense, and time required for further litigation.
