Current and former patients who received written notice that their private information may have been affected by in the Onsite Mammography data breach, may be eligible to submit a claim for up to $5,000 plus credit monitoring from a class action settlement. The cybersecurity incident compromised 357,265 individuals.

Onsite Mammography LLC, doing business as Onsite Women’s Health, has agreed to pay $2.53 million to settle a class action lawsuit related to a data security incident in October 2024. The lawsuit alleged that Onsite failed to adequately protect personal and health information.

Who can file a claim for a data breach payout?

Class members are individuals residing in the United States who received written notice from Onsite Mammography that their personally identifiable information (PII) and/or protected health information (PHI) may have been impacted by the October 2024 data breach.

How much are settlement payments

Class members have the following benefit options:

  • Reimbursement for out-of-pocket losses: Class members can claim up to $5,000 in documented, unreimbursed losses resulting from the data breach. This includes credit report fees, costs for freezing/unfreezing credit reports, credit monitoring or mitigation expenses and postage for contacting financial institutions.
  • Pro rata cash payment: All class members can submit to receive a pro rata cash payment from the net settlement fund after all other approved claims are paid. Payment amount will be determined by the total number of claims filed.
  • Credit and medical/health data monitoring (CMIS): All class members can elect to receive three years of CMIS. Services include three-bureau credit monitoring and $1 million in identity theft insurance.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

Settlement fund breakdown

  • Credit and medical/health data monitoring: Cost determined by the number of claims filed
  • Payments to approved claimants: Remaining settlement funds

Why was there a class action settlement?

The class action lawsuit alleged that Onsite Mammography LLC was responsible for a cybersecurity incident in October 2024, when an unauthorized third party gained access to an employee’s email account. Plaintiffs claimed the company failed to adequately protect personal and health information, raising claims of negligence, breach of implied contract, breach of fiduciary duty, invasion of privacy, unjust enrichment, and declaratory judgment.

Onsite Mammography denies any wrongdoing, but agreed to settle to avoid the expense and risk of continued litigation and a possible trial.
