Individuals who received a notification from Signature Performance Inc., Adventist Health Tulare and Adventist Health System/West, or Southeastern Regional Medical Center d/b/a UNC Health Southeastern stating a January 2024 data breach may have compromised their private information could be eligible to claim up to $5,000 plus other benefits from a class action settlement.

Signature Performance Inc. agreed to pay $8.5 million to settle a class action lawsuit alleging it failed to adequately protect sensitive personal and health information during a cybersecurity incident.

Who can file a data breach claim?

Class members include both patients and employees who meet the following criteria:

  • They reside in the United States.
  • They received a notification letter from Signature Performance Inc., Adventist Health Tulare and Adventist Health System/West, or Southeastern Regional Medical Center d/b/a UNC Health Southeastern informing them the January 2024 data incident potentially compromised their private information.

How much can class members get?

The total settlement fund is $8,500,000. After deducting attorneys’ fees, service awards, settlement administration costs and medical data monitoring costs, the settlement administrator will distribute the remaining funds to class members. All payments are subject to pro rata adjustment based on the number of valid claims and the net settlement fund after costs and fees.

  • Documented loss payment (Cash Payment A): Up to $5,000 per person for documented, unreimbursed losses resulting from the data incident. Class members must submit third-party documentation, such as receipts, bank statements or other proof of expenses (e.g., credit monitoring, late fees, unauthorized charges, costs related to identity theft, etc.).
  • Undocumented cash payment (Cash Payment B): An estimated $200 payment for class members who do not have documentation of losses. This option does not require supporting documentation.
  • California statutory cash payment: An additional estimated $200 for class members who resided in California at the time of the incident. This is in addition to either of the above cash payments.
  • Medical data monitoring: All class members may elect to receive three years of medical data monitoring, which includes single-bureau credit monitoring, medical identity monitoring, real-time alerts and up to $1,000,000 in identity theft insurance.

How to claim a Signature Performance payout

Class members can file a claim online or download, print and complete a PDF claim form to mail to the settlement administrator.

The claim deadline is May 7, 2026. Claims the settlement administrator receives after this date are not eligible for payment.

What do class members need to submit a claim?

  • All class members must provide the class member ID from the settlement notice they received. Online claimants must also provide the PIN from the same notice.
  • Those claiming a documented loss payment must provide third-party documentation (receipts, bank statements, etc.) for reimbursement of up to $5,000 in losses.
  • Those claiming the California statutory payment must attest to California residency at the time of the incident.
  • Those claiming the undocumented cash payment or medical data monitoring need only select the appropriate option on the claim form.

The fund is nonreversionary, meaning the settlement administrator will donate any remaining funds after it pays all claims to an approved cy pres recipient.

When is the Signature Performance settlement payout date?

The settlement administrator will distribute payments and benefits approximately 45 days after the court resolves any appeals and grants final approval of the settlement.

Why is there a class action settlement?

The class action lawsuit alleged Signature Performance Inc. failed to adequately protect sensitive personal and health information, resulting in a data breach in January 2024. The plaintiffs claimed the breach exposed private information and caused financial and emotional harm.

The company denies any wrongdoing but agreed to settle to avoid the costs and risks of ongoing litigation.
