Albany Gastroenterology Consultants Data Breach Settlement

Patients who received direct notice that the November 2024 Albany Gastroenterology Consultants data breach may have compromised their private information could be eligible to claim up to $2,500 from a class action settlement.

Albany Gastroenterology Consultants PLLC agreed to settle a class action lawsuit alleging it failed to protect patient data during a targeted cyberattack in November 2024. The settlement provides compensation and credit monitoring to individuals whose private information the unauthorized individuals accessed.

Who can file a claim?

The class includes anyone who received direct notice that the November 2024 data breach at Albany Gastroenterology Consultants PLLC may have compromised their private information.

How much can class members get?

Each class member may claim one cash payment:

• Cash payment A (out-of-pocket expenses): Class members who incurred actual, documented out-of-pocket losses between Nov. 10, 2024, and Oct. 5, 2026, due to the data breach can claim reimbursement up to $2,500. Eligible expenses include:
• Losses from identity theft or fraud
• Fees for credit reports, credit monitoring or freezing/unfreezing credit
• Costs to replace IDs
• Postage to contact banks by mail

• Cash payment B (alternative cash payment): Class members who do not have documented out-of-pocket losses may claim a one-time cash payment. This payment is expected to be $10, but the final amount may be higher or lower depending on the total number of claims.

There is a cap of $200,000 on the total cash benefits split evenly between the two payment types:

• $100,000 cap for cash payment A (out-of-pocket expenses)
• $100,000 cap for cash payment B (alternative cash payment)

If the total value of claims in either category exceeds the cap, the settlement administrator will reduce payments proportionally (pro rata) so the total does not exceed $100,000 for each category.

All class members should have automatically received an enrollment code for two years of CyEx Medical Shield Complete credit monitoring. This service includes $1 million of medical identity theft insurance and monitors for health care insurance ID exposure, medical record number exposure and unauthorized health savings account spending. If the program detects suspicious activity, class members will have access to a fraud resolution agent.

How to claim a settlement payment

Class members can file a claim online or download, print and complete a PDF claim form to mail or email to the settlement administrator. They can request a paper claim form by contacting the settlement administrator.

Class members who did not receive a credit monitoring enrollment code should contact the settlement administrator for assistance. They do not need to submit a claim form to receive this benefit.

Required information

• For cash payment A (out-of-pocket expenses), class members must provide documentation, such as receipts, bank statements or other proof showing the expenses and relation to the data breach. Self-prepared notes alone are not sufficient, but class members can include them to explain their documentation.
• For cash payment B (alternative payment), class members do not need to submit documentation. They must simply attest to their eligibility.
• For online claims, class members must provide the login ID and PIN from the settlement notice they received.

Settlement fund breakdown

A $200,000 settlement fund will cover all cash payments to class members. The fund is split between the cash payments:

Albany Gastroenterology Consultants will pay all other costs separately from the $200,000 class member payments:

• Attorneys' fees and costs: $300,000
• Service awards to class representatives: $2,500 each
• Credit monitoring costs: Determined by number of class members who redeem

When is the Albany Gastroenterology Consultants data breach settlement payout date?
