Individuals who received a notice that the Coleman Professional Services data incident that occurred between Sept. 18 and Oct. 31, 2023, compromised their personal information may be eligible to claim a cash payment from a class action settlement.

Coleman Professional Services Inc. agreed to pay $950,000 to resolve a class action lawsuit alleging it failed to implement and maintain reasonable security measures to protect sensitive personal information. The lawsuit claims unauthorized individuals accessed sensitive information, including names, dates of birth, Social Security numbers, driver’s license or state-issued ID numbers, financial account details, treatment and diagnosis information, patient identification numbers, and health insurance or payment information.

Who can file a claim?

Class members must meet the following criteria:

  • They are a United States resident.
  • The Coleman Professional Services data incident that occurred between Sept. 18 and Oct. 31, 2023, potentially compromised their private information.
  • They received direct notice of the data incident from Coleman Professional Services Inc.

The settlement administrator will verify all claims.

How much can class members get?

  • Reimbursement for documented out-of-pocket losses: Up to $5,000 per person for losses or expenses incurred on or after September 2023 that are fairly traceable to the data incident. Eligible losses include:
    • Unreimbursed costs, expenses or losses due to identity theft or fraud, falsified tax returns or misuse of Social Security numbers
    • Costs to access, freeze or unfreeze credit reports with any credit reporting agency
    • Miscellaneous expenses, such as notary, fax, postage, copying, mileage and long-distance telephone charges
    • Unpaid time off work to address issues related to the data incident calculated at the actual hourly rate
    • Other mitigation costs directly related to the data incident
  • Cash payment: Approximately $70 per class member subject to pro rata adjustment depending on the number of claims and the amount remaining in the settlement fund after the settlement administrator pays attorneys’ fees and costs, administration costs, service awards and valid out-of-pocket loss claims. The estimated $70 payment assumes a 10% claim rate among the roughly 51,889 class members.
  • Credit monitoring: All class members can claim one year of three-bureau identity and credit monitoring in addition to the cash payment and/or reimbursement for losses.

How to claim a class action settlement payment

Class members can submit the online claim form or download, print and complete the PDF claim form and mail it to the settlement administrator. They may also request a paper claim form by calling 800-430-8205, emailing ColemanSettlement@AtticusAdmin.com or writing to the settlement administrator.

Is proof or documentation required to submit a claim?

Yes, class members must submit documentation for certain types of claims:

  • For reimbursement of out-of-pocket losses, class members must provide documentation supporting the claimed loss, such as receipts, bank statements or bills and a brief description of the loss (if not apparent from the documentation). Self-prepared documents (like handwritten receipts) are not sufficient on their own, but class members may use them to clarify other documentation.
  • For the cash payment and identity monitoring, class members do not need to provide documentation. They need only select the appropriate option on the claim form.
  • For online claims, class members must provide their last name and the claimant ID from the settlement notice they received.

Payout options

  • Paper check mailed to the claimant’s address
  • Electronic payment (if submitting an online claim)

All checks expire and become void 180 days after issuance.

$950,000 settlement fund breakdown

The $950,000 settlement fund will cover:

  • Settlement administration costs: $100,000 (initial payment)
  • Attorneys’ fees: Up to $400,000
  • Attorneys’ expenses: Up to $30,000
  • Service awards to class representatives: Up to $5,000 each
  • Credit monitoring costs: Determined by number of valid claims for this option
  • Payments to class members: Remainder of the fund

Coleman Professional Services Inc. also spent approximately $250,000 on business practice changes to improve data security (not part of the settlement fund).

  • Deadline for exclusion: Sept. 4, 2026

When is the Armstrong v. Coleman Professional Services payout date?

The settlement administrator will issue payments within 30 days after the court resolves any appeals and grants final approval to the settlement.

Why did this class action settlement happen?

The class action lawsuit alleged Coleman Professional Services Inc. failed to implement and maintain reasonable security measures to protect sensitive private information, leading to a data breach in which unauthorized individuals accessed email accounts containing personal and health information.

Coleman denies any wrongdoing but agreed to settle to avoid the uncertainty, risks and expenses of ongoing litigation and provide compensation to affected individuals more quickly.
