Individuals who purchased, paid for, or reimbursed the cost of SmileDirectClub aligners for personal use in the United States between Oct. 22, 2017, and Aug. 18, 2022, may qualify to submit a claim for a cash payment, estimated between $40 and $60, from a class action settlement.
Align Technology Inc. has agreed to pay $31.75 million to resolve a class action lawsuit alleging that its business practices with SmileDirectClub LLC led to higher prices for consumers. The lawsuit claimed that Align engaged in anticompetitive conduct in violation of the federal Sherman Antitrust Act.
Who can file a claim?
Class members must meet the following criteria:
- They purchased, paid for, or provided reimbursement for some or all of the purchase price for SmileDirectClub aligners acquired for personal use.
- The purchase or payment must have occurred between Oct. 22, 2017, and Aug. 18, 2022.
How much is the settlement payment?
Cash payment: Eligible cash members will receive a cash payment, estimated between $40 and $60. Final payment amount will be determined by the total number of eligible class members in SmileDirectClub's records and claims filed.
How to claim a class action rebate
- Class members identified in SmileDirectClub’s records do not need to submit a claim and will receive an automatic payment.
- Class members identified mileDirectClub’s records must file a claim to receive a settlement payment. A claim can be file a claim online or class members can print the PDF claim form and mail it to the settlement administrator.

Required claim information
Class members not identified in SmileDirectClub’s records must provide the following information on their claim form:
- Date of purchase of SmileDirectClub aligners
- Mailing address at the time of purchase
- Email address associated with your SmileDirectClub account
- Claimants may also attach documentation such as a receipt or credit card statement as proof of purchase

$31.75 million SmileDirectClub settlement fund
The $31,750,000 settlement fund will include:
- Settlement administration costs: Up to $2,500,000
- Attorneys' fees: Up to $7,937,500
- Attorneys' expenses: To be presented to the court for approval at a later date
- Service awards to class representatives: Up to $7,500 each
- Payments to eligible class members: Remainder of the net settlement fund after all deductions

When is the Snow v. Align Technology Inc. payout date?
Payments to eligible class members will be issued after the court grants final approval of the settlement and claim processing is completed.
Why did this class action settlement happen?
This lawsuit, known as Snow v. Align Technology Inc., alleged that Align entered into an anticompetitive agreement with SmileDirectClub LLC, which suppressed competition in the direct-to-consumer aligner market. Plaintiffs claimed that this conduct violated the federal Sherman Antitrust Act and resulted in consumers paying more for SmileDirectClub products.
Align denies any wrongdoing, but both sides agreed to settle to avoid the risks and uncertainty of further litigation.
