
Consumers who purchased, paid for or provided reimbursed for the cost of SmileDirectClub aligners for personal use in the United States between Oct. 22, 2017, and Aug. 18, 2022, may be eligible to submit a claim for a cash payment, estimated between $40 and $60, from a class action settlement.
Align Technology Inc. agreed to pay $31.75 million to settle a class action lawsuit. The class action alleged Align engaged in anticompetitive conduct through its relationship with SmileDirectClub LLC, which caused consumers to overpay for SmileDirectClub aligners.
Who is eligible for a SmileDirectClub payout?
Class members must meet the following criteria:
- They are an individual in the United States who purchased, paid for or provided reimbursement for some or all of the purchase price of SmileDirectClub aligners.
- Individuals who paid on behalf of someone else or reimbursed another person for the purchase are included.
- The aligners were acquired for personal use.
- The purchase occurred between Oct. 22, 2017, and Aug. 18, 2022.
How much is the class action settlement payment?
Pro rata cash payment: Eligible class members and approved claimants will receive a cash payment estimated between $40 and $60. Final payment amount will be determined by the number of approved claims but will not be less than $10.
How to claim a class action rebate
Class members that have been automatically identified through SmileDirectClub purchase records do not need to submit a claim to receive a payment.
Class members that were not identified in SDC records must file a claim to receive a settlement payment. These class members can file a claim online or download and print the PDF claim form and mail it to the settlement administrator.

Payout options
Class members will select from one of the following payment options:
- Venmo
- PayPal
- Zelle
- Paper check mailed to the address provided
$31.75 million SmileDirectClub settlement fund
The $31,750,000 settlement fund will include:
- Settlement administration costs: Up to $2,500,000
- Attorneys’ fees: Up to $7,937,500
- Attorneys’ expenses: Amount to be presented to court for approval at a later date
- Service awards to class representatives: Up to $7,500 each
- Payments to eligible class members: Remaining settlement funds

When is the SmileDirectClub class action settlement payout date?
Payments will be issued to eligible class members after the court grants final approval of the settlement and claim processing is complete.
Why did this class action lawsuit and settlement happen?
This class action lawsuit was filed because plaintiffs alleged that Align Technology Inc. entered into an anticompetitive agreement with SmileDirectClub LLC, which suppressed competition in the direct-to-consumer aligner market.
Plaintiffs claimed this conduct violated the federal Sherman Antitrust Act and led to consumers overpaying for SmileDirectClub aligners. Align denies these allegations but agreed to settle to avoid the risks and expense of further litigation and a possible trial.
