
Employees recruited as TN visa holders by Total Employee Solution Support LLC, SPJ Connect Inc. or GB2G Inc. (d/b/a Allswell), whom Allswell assigned to work at Mobis Alabama LLC d/b/a Hyundai Mobis or Kia Georgia Inc. at their West Point, Georgia, locations, and who received wages from Allswell between Aug. 11, 2018, and the present may be eligible to claim a cash payment from a class action settlement.
Kia Georgia Inc., Mobis Alabama LLC d/b/a Hyundai Mobis, GB2G Inc. d/b/a Allswell, SPJ Connect Inc. and Youngjin Lee agreed to pay $11.5 million to settle a class action lawsuit alleging they misrepresented job terms and violated state and federal statutes affecting TN visa workers at their Georgia facilities.
Who are the class members?
Individuals meet all of the following criteria:
- Total Employee Solution Support LLC, SPJ Connect Inc. or GB2G Inc. d/b/a Allswell recruited them.
- Allswell assigned them to work at either Mobis Alabama LLC d/b/a Hyundai Mobis or Kia Georgia Inc. at their West Point, Georgia, locations.
- They received wages from Allswell.
- They held a TN visa at any time between Aug. 11, 2018, and the present.
The class includes approximately 614 individuals, including the named plaintiffs. The settlement divides class members into four groups based on the number of days worked and the period of assignment:
- Group 1: Assigned for at least one day but no more than 60 days
- Group 2: Assigned for more than 60 days but no more than 120 days
- Group 3: Assigned for more than 120 days but no more than 400 days
- Group 4: Assigned for more than 400 days
How much can class members receive?
The settlement provides for two types of payments: one for alleged wage violations under the Fair Labor Standards Act and another for alleged fraud under Rule 23. Class members are eligible for both types of payments.
- FLSA settlement: Each eligible class member will receive $30 per week worked at Hyundai Mobis or Kia Georgia between Aug. 11, 2019, and the present. The average class member worked 54 weeks so the average payment is $1,672.61. The settlement administrator will report half of this payment as W-2 wages (with tax withholding) and half as 1099 liquidated damages (no withholding).
- Rule 23 settlement: Payment depends on the group the class member belongs to based on the number of days they worked and the assignment date. The settlement administrator will report all Rule 23 payments as IRS Form 1099 income.
- Group 1: $4,112.50 for 1-60 days worked
- Group 2: $8,000 for 61-120 days worked
- Group 3: $16,800 for 121-400 days worked (minus $2,500 if assigned after Dec. 31, 2023)
- Group 4: $11,100 for more than 400 days worked (minus $2,500 for 100 members assigned after Dec. 31, 2023)
How to claim a settlement payout
Cass members must complete and submit a settlement distribution form online or print, complete and mail or email it to the PDF form (pages 78-79 of the settlement agreement) to the settlement administrator.

Class members whose address changes before they receive payment must update their information with Atticus Administration.
What proof or documentation is necessary to submit a claim?
All class members must provide:
- Name and address
- Date of birth
- Gender
- Social Security number (if any)
- Whether they are or were a U.S. permanent resident or citizen
- Bank account or payment details for electronic or wire transfer payment or mailing address for check payment
- A statement regarding Medicare beneficiary status
- Signature and date
To file an online claim, class members must log in using the notice ID from their settlement notice and last name.

When is the Martinez v. Mobis Alabama LLC et al. payout date?
The settlement administrator will distribute settlement funds on or before the later of 60 days after the final settlement date or 60 days after receipt of the settlement distribution form.
Why is there a class action settlement?
The class action lawsuit alleged Kia Georgia Inc., Mobis Alabama LLC d/b/a Hyundai Mobis, GB2G Inc. d/b/a Allswell, SPJ Connect Inc. and Youngjin Lee misrepresented job terms and wages to TN visa holders they recruited to work at Mobis and Kia Georgia in West Point, Georgia. The plaintiffs claimed the defendants violated federal and Georgia RICO statutes and federal wage laws under the Fair Labor Standards Act.
The defendants denied all wrongdoing but agreed to settle to avoid the uncertainty and expense of continued litigation.
