
Consumers who previously received a settlement notice about the December 2023 MedQ data breach may be eligible to claim up to $5,000 from a class action settlement.
MedQ Inc. agreed to settle a class action lawsuit alleging it failed to protect personal and health information during a targeted cyberattack that occurred on or about Dec. 26, 2023. The data breach involved unauthorized access to files containing sensitive information, including:
- Names
- Social Security numbers
- Driver’s license numbers
- Dates of birth
- Health and insurance details
- Diagnoses
- Lab results
Who can file a claim?
The class includes all U.S. residents who received a data breach notification letter from MedQ Inc.
How much is the MedQ payout?
- All class members are eligible to enroll in two years of credit monitoring services from all three major credit bureaus. This service includes:
- Real-time monitoring at all three bureaus
- Dark web scanning
- Comprehensive public records monitoring
- Medical identity monitoring
- Identity theft insurance
- Access to a fraud resolution agent if suspicious activity is detected
Class members may also choose between two main cash payment options:
- Option 1: Cash payment for documented losses and lost time: Up to $5,000 reimbursement for actual, documented out-of-pocket expenses related to the data breach. Eligible expenses include:
- Losses due to identity theft or fraud
- Fees for credit reports, credit monitoring or freezing/unfreezing credit
- Costs to replace identification documents
- Postage for contacting banks or other institutions
- To claim this benefit, class members must provide supporting documentation, such as bank statements or receipts. They may include self-prepared notes or explanations to supplement their claim, but these are not sufficient on their own.
- Class members may also claim compensation for time spent responding to the breach up to three hours at $30 per hour (maximum $90 and under the $5,000 cap). This requires an attestation describing the tasks performed, such as changing passwords or investigating suspicious activity.
- Option 2: Alternative cash payment
- Those who do not have documented losses or lost time or do not wish to submit documentation may claim a one-time $50 cash payment. No proof or explanation is needed for this option.
How to claim a settlement payout
Class members can file a claim online or download, print and complete the PDF claim form and mail or email it to the settlement administrator.

Required proof and information
- To claim reimbursement for documented losses, class members must provide supporting documentation, such as receipts, bank statements or other proof of expenses.
- To claim lost time, class members must provide a brief description and attest to the number of hours spent.
- No documentation is required to claim the $50 alternative payment.
- To file an online claim form, class members must log in with their unique ID and PIN, which is located on the settlement notice they received. Those who are unable to locate their ID and PIN should contact the settlement administrator by emailing info@MedQIncDataSettlement.com or calling 833-417-4905 and providing their full name and mailing address.

Settlement fund breakdown
The settlement fund includes:
- Settlement administration costs: Up to $100,000 (estimated)
- Attorneys’ fees and costs: Up to $350,000
- Service awards to class representatives: Up to $1,000 each
- Payments to eligible class members: The remainder of the fund

When is the MedQ Inc. data breach settlement payout date?
Class members will receive their payments no later than 30 days after the settlement administrator resolves appeals or 75 days after final settlement approval, whichever is later.
Why is there a class action settlement?
The class action lawsuit alleged a targeted cyberattack on MedQ Inc.’s computer systems in December 2023 resulted in unauthorized access to files containing personal and health information. The plaintiffs alleged MedQ Inc. failed to adequately protect this sensitive data.
MedQ denies any wrongdoing, but both sides agreed to settle to avoid the risks, costs and uncertainties of continued litigation.
