Consumers who had a credit card issued in Maryland by First Bank & Trust and serviced by Mercury Financial at any time from August 2018 to the present may qualify to claim a $65 to $100 payment from a class action settlement.

Mercury Financial LLC agreed to pay $5.75 million to settle a class action lawsuit alleging it made or serviced personal loans less than $25,000 to Maryland consumers without the license required by Maryland law.

Who are the class members?

Class members must meet all of the following criteria:

  • They are a Maryland resident.
  • They had a credit card account issued by First Bank & Trust SD (FB&T).
  • Mercury Financial LLC serviced their account on or after August 2018.
  • They made at least one payment on the loan.

Up to 60,000 Maryland residents may be eligible for a settlement payment. Each eligible account is entitled to only one payment. If there are co-borrowers on an account, they will be treated as a single class member for the purposes of the settlement.

How much can class members get?

The settlement fund is $5,750,000. After deducting attorneys' fees, costs and administration expenses, the settlement administrator will distribute the remainder of the fund equally among all eligible class members. The estimated payment per class member is approximately $65. If fewer people participate, the payment could be as high as $100 per person.

If any money remains in the fund after all payments are made (for example, if some checks are not cashed), the settlement administrator will donate the remaining funds to designated nonprofit organizations as outlined in the settlement agreement. The first $5,000 will go to Economic Action Maryland, the next $5,000 to Maryland Legal Aid Bureau, another $5,000 to the National Consumer Law Center and any remaining funds to the University of Maryland Francis King Carey School of Law.

No action needed to receive payment

Class members do not need to file a claim to receive payment. They will automatically receive a check after the settlement receives final court approval and the settlement administrator resolves any appeals.

The settlement administrator will mail checks to the last known address on file. Class members whose address has changed should contact the settlement administrator to update their information.

$5.75 million settlement fund breakdown

The $5,750,000 settlement fund covers:

  • Settlement administration costs: To be determined
  • Attorneys' fees: $1,916,666.67
  • Payments to eligible class members: Remainder of the fund after deductions

Mercury will pay a $15,000 service award to the class representative separately (not from the main fund).

When is the Maryland Mercury Settlement payout date?

The settlement administrator will mail payments approximately 30 days after the court grants final approval of the settlement and resolves any appeals.

Why did this class action settlement happen?

The class action lawsuit alleged Mercury Financial LLC made or serviced personal loans less than $25,000 to Maryland consumers without the license required by Maryland Consumer Loan Law. The plaintiff claimed these loans were void and unenforceable under state law and that Mercury was not entitled to retain amounts collected on these loans.

Mercury denied any wrongdoing but agreed to settle the lawsuit to avoid the cost, risk and uncertainty of continued litigation.
