
Betacom Holdings Inc. or Betacom Inc. employees who worked at any time between Aug. 6, 2021, and Aug. 8, 2025, may be eligible to claim a cash payment from a class action settlement.
Betacom Holdings Inc. and Betacom Inc. agreed to pay $1.2 million to resolve a class action lawsuit alleging they failed to pay certain employees overtime wages owed under federal and state law. The lawsuit claimed the companies did not compensate employees for overtime worked through meal periods and did not include some hours in the regular rate of pay for overtime calculations.
Who is eligible to file a claim?
Individuals must meet all of the following criteria:
- They worked as a field employee for Betacom Holdings Inc. or Betacom Inc.
- Betacom employed them at any time from Aug. 6, 2021, to Aug. 8, 2025.
Betacom’s records identified 617 class members. Only these individuals are eligible to participate in the settlement and receive a payment.
How much is the Betacom payout?
Pro rata payment: The total net settlement amount available for distribution among class members is estimated at $676,000 after deductions for attorneys’ fees and costs, settlement administration costs and a service award for the lead plaintiff.
The settlement administrator will determine the amount each class member can receive using a pro rata calculation, which takes into account the number of overtime weeks worked and the individual’s pay rate.
Each class member’s award = (number of overtime weeks worked) x (per workweek share based on pay rate and total fund)
The settlement administrator will treat 50% of each payment as W-2 wages (subject to payroll taxes) and 50% as 1099 income.
If a class member does not file a claim, their share reverts to Betacom and is not redistributed among other class members.
How to claim a class action payment
Eligible class members can complete the online claim form or download, print and fill out the PDF claim form and mail, email or fax it to the settlement administrator. The claim deadline is Dec. 17, 2025.

What is required to submit a claim?
To file an online claim, class members must provide the CPT ID and passcode from the settlement notice they received. Those who do not have a CPT ID and/or passcode should email LayBetacomHoldingsSettlement@cptgroup.com.
Payout options
The settlement administrator will mail checks to eligible class members.
- Each class member will receive two checks: one for 50% of the award as W-2 wages (subject to payroll taxes) and one for 50% as 1099 income.
- After 120 days, the settlement administrator will send uncashed checks to the Washington Unclaimed Property Fund.

- Settlement administration costs: Up to $15,000
- Attorneys’ fees: $480,000
- Attorneys’ expenses: up to $19,000
- Service award to lead plaintiff: Up to $10,000

When is the Lay v. Betacom Holdings Inc. payout date?
The settlement administrator will mail payments after it completes claim review and the court grants final approval of the settlement.
Why is there a class action settlement?
The class action lawsuit alleged Betacom Holdings Inc. and Betacom Inc. failed to pay employees for all overtime hours worked, including time worked through meal periods and certain payments not included in the regular rate for overtime. The settlement resolves claims under federal and state wage laws, including the Fair Labor Standards Act and the Massachusetts Wage Act.
Betacom denies all allegations but agreed to settle to avoid further litigation and expense.
