How much can class members get?
The total amount each class member will receive depends on several factors, including the number of eligible shifts they worked during the covered period and the total number of participating claimants. The settlement administrator will distribute the net settlement fund, after deductions for attorneys’ fees, costs and a service award to the named plaintiff, to eligible class members who submit a valid claim form.
The administrator will calculate the settlement payments on a pro rata basis using the following formula:
- The net settlement fund / the total number of shifts all participating class members worked = the value per shift
- The value per shift x the number of shifts an individual worked = each class member’s share
The settlement notice class members received specifies each individual's actual payment amount. The gross amount is subject to required payroll tax withholdings and deductions.
Additional details:
- Fifty percent of the settlement payment is considered wage income, will be reported on IRS form W-2 and is subject to payroll tax withholdings.
