Cupertino Electric Inc. has agreed to pay $740,520 to settle a class action lawsuit related to a data breach that occurred in June 2023. The lawsuit alleged that Cupertino Electric failed to adequately protect personal information, resulting in unauthorized access to sensitive data.
Who is eligible for a data breach payout?
Class members are current and former employees in the United States who received a notice from Cupertino Electric regarding the data breach, which was sent on or around June 28, 2023.
How much is the class action settlement payment?
Claimants can select one or more of the following:
- Reimbursement for documented out-of-pocket losses: Class members may submit to receive up to $5,000 in reimbursement for actual documented expenses and losses traceable to the data breach. Eligible expenses include costs related to addressing identity theft or fraud, purchasing credit monitoring, placing security freezes, obtaining credit reports, and other documented losses not reimbursed by other sources.
- Alternative pro rata cash payment: Class members that do not submit a documented losses claim can submit to receive a pro rata cash payment from the remaining settlement fund. Final payment amount will be determined by the number of valid claims submitted and the funds left after other expenses are paid.
- Credit monitoring and identity theft protection services: All class members can claim two additional years of three-bureau credit monitoring, which includes identity theft insurance coverage of up to $1 million. This benefit is in addition to the 24 months of credit monitoring previously offered by Cupertino Electric after the breach.
How to claim a class action rebate
To receive a settlement payment, a claim must be filed by the deadline of November 6, 2025. Class members have the following submission options:

- Print the PDF claim form, and mail it to the settlement administrator

When is the Cupertino Electric data breach settlement payout date?
