Patients who used BJC’s MyChart patient portal between June 2017 and August 2022 may qualify to claim at least $35 from a class action settlement.

BJC Health System, doing business as BJC HealthCare, agreed to pay up to $9.25 million to resolve a class action lawsuit alleging it disclosed the personally identifiable information and protected health information of patients who accessed the BJC MyChart patient portal during the specified period.

Who can file a BJC HealthCare claim?

Class members must have used BJC’s MyChart patient portal at any time between June 2017 and August 2022.

This includes anyone who accessed their health information or communicated about bills, appointments or other services through the MyChart portal during the class period.

How much can class members get?

Each eligible class member who submits a valid claim can receive a cash payment of $35. The actual amount may increase or decrease depending on the total number of valid claims submitted and deductions for administrative costs, attorneys’ fees and service awards.

How to claim a data privacy payment

Class members can file a claim online or download, print and complete a PDF claim form and mail it to the settlement administrator. The claim form must be submitted online or postmarked by Oct. 8, 2025.

What is required to submit a claim?

To file an online claim, class members must provide the unique ID and PIN printed at the bottom of the email notice they received. Those who received a postcard notice can locate the unique ID and PIN on the inside panel.

Class members who did not receive an email or postcard notice or have lost theirs will need to fill out the PDF claim form and mail it to the settlement administrator.

$9.25 million settlement fund breakdown

The settlement fund of up to $9.25 million begins with a $5.5 million payment. If that is insufficient to cover all payments to class members, as well as administrative expenses, attorneys’ fees and service awards to the class representatives, BJC HealthCare will supplement the initial $5.5 million with up to $3.75 million.

The fund will be allocated as follows:

  • Settlement administration costs: Up to $200,000
  • Attorneys' fees: Up to $3,000,000
  • Attorneys' expenses: To be determined
  • Service awards to class representatives: $15,000
  • Payments to eligible class members: The remainder of the fund

  • Opt-out deadline: Sept. 8, 2025

  • Final approval hearing: Oct. 16, 2025

When is the BJC HealthCare Privacy Settlement payout date?

Payments will be distributed approximately 61 days after the court grants final approval of the settlement and any appeals are resolved.

Why was there a class action settlement?

The class action lawsuit alleged BJC HealthCare’s websites transmitted personally identifiable and protected health information to third-party companies, such as Facebook and Google, without patient consent through the MyChart patient portal and related web properties between June 2017 and August 2022.

BJC denies any wrongdoing or liability but agreed to settle to avoid the risks and costs of continued litigation. The settlement provides compensation to affected individuals and resolves the claims without a trial.
