Consumers who received a notification from Xavier University of Louisiana in or around February 2023 stating their personal information may have been impacted in a data breach may qualify to claim up to $5,000 from a class action settlement.

Xavier University of Louisiana agreed to pay $750,000 to settle a class action lawsuit alleging it failed to protect the personal information of students, employees and others. The plaintiffs claim this negligence led to a November 2022 data breach in which an unauthorized third party may have accessed and acquired class members' full names and Social Security numbers.

The class includes approximately 44,312 individuals who received such notification.

How much is the data breach payout?

Class members may submit a claim for one or both of these benefits:

  • Documented Out-of-Pocket Losses: Reimbursement for actual, unreimbursed expenses up to $5,000 per person. These expenses must be traceable to the data breach and incurred between Nov. 22, 2022, and Aug. 13, 2025.
  • Pro Rata Cash Payment: A cash payment from the settlement fund distributed equally among valid claimants who request this payment.

  • To file a claim for documented out-of-pocket losses, class members must provide documentation, such as receipts, account statements or other official records, showing the expense and its connection to the data breach.
    • Self-prepared documents (like handwritten receipts) are not sufficient alone but can be submitted as clarification to official documents.
    • Eligible out-of-pocket losses include:
      • Unreimbursed losses relating to fraud or identity theft
      • Professional fees, such as attorneys’ fees, accountants’ fees and credit repair service fees
      • Costs associated with freezing or unfreezing credit with any credit reporting agency
      • Credit monitoring costs incurred on or after the data breach through the date of claim submission
      • Transportation expenses for trips to a financial institution to address fraudulent charges or receive a replacement payment card
      • Verified fraud, such as fraudulent bank or credit card charges, fraudulent tax filings, fraudulent opening or closing of bank or credit accounts, fraudulent unemployment filings or other fraudulent actions using information obtained from the data breach
      • Miscellaneous expenses, such as notary, postage and mileage
      • Other expenses reasonably attributable to the breach that were not reimbursed

$750,000 data breach settlement fund breakdown

The $750,000 settlement fund covers:
