
Individuals who worked as a nonexempt employee or contractor selling or promoting goods in Safeway or Albertsons stores or Costco warehouses in California between June 12, 2015, and Nov. 4, 2025, may qualify to claim a cash payment from a class action settlement. The settlement class includes an estimated 1,335 workers.
Safeway Inc., Albertsons Cos. Inc., Costco Wholesale Corp. and Advantage Solutions agreed to pay $1.04 million to resolve allegations of California labor law violations, including failure to provide meal and rest breaks, unpaid wages and related claims. The settlement includes $475,000 from Albertsons and Safeway, $475,000 from Advantage and $85,000 from Costco.
Who can file a claim for a payout?
Class members must meet one of the following criteria:
- They worked as a nonexempt employee or contractor of Safeway or Albertsons, or for any staffing agency or third party, selling or promoting goods in Safeway stores or stores owned or operated by Safeway in California between June 12, 2015, through Nov. 4, 2025.
- They worked as a nonexempt employee for Advantage Solutions, or for any third party vendor or contractor who contracted with Advantage to provide staff to Safeway locations, to sell or promote goods in Safeway stores in California between June 12, 2015, through Nov. 4, 2025.
- They worked as a nonexempt employee for Integro Marketing Group, or for any third party vendor or contractor who contracted with Integro to provide staff to Costco warehouses, to sell or promote goods in Costco warehouses in California between June 12, 2015, through Nov. 4, 2025.
How much is the class action settlement payment?
- Cash payment: Each eligible class member who submits a valid claim will receive a cash payment from the net settlement fund based upon the number of shifts they worked during the class period and what company they worked for.
- Class members who sold or promoted goods at Safeway will receive a payment from the combined Safeway, Albertsons and Advantage net settlement contributions.
- Class members who sold or promoted goods at Costco will receive a payment from the Costco net settlement contribution.
- PAGA cash payment: All class members will receive a pro rata PAGA cash payment based on the number of shifts they worked during the PAGA period regardless of whether or not they opt out of the settlement.
- The PAGA period is Nov. 14, 2024, through Nov. 4, 2025.
How to claim a settlement payment
Class members who received a settlement notice in the mail do not need to submit a claim to receive a payment. These class members can challenge the number of shifts listed in their settlement notice by mailing or emailing a written notice to the settlement administrator.
Class members who did not receive a settlement notice in the mail must file an online claim form or download and print the PDF claim form to mail or email to the settlement administrator.

Required proof and claim information
- Class members submitting a claim or challenge must provide supporting documentation, which may include agency invoices, payment records, employment contracts or emails and other communication indicating they sold or promoted goods in Safeway or Albertsons stores or Costco warehouses.
- Class members submitting a claim must include their Social Security number or Tax ID on the claim form.
Payout options
The settlement administrator will mail paper checks mailed to the address they sent the settlement notice to or the one the class member provides on the claim form.
$1.04 million settlement fund breakdown
The $1,035,000 settlement fund will include:
- Settlement administration costs: Up to $30,000
- Attorneys' fees: Up to $345,000
- Attorneys' expenses: Up to $50,000
- Service award to class representative: Up to $15,000
- PAGA penalties: $7,500 to the state and $2,500 to aggrieved employees ($10,000 total)
- Payments to eligible class members: Remaining settlement funds

When is the Safeway, Albertsons and Costco wage-and-hour settlement payout date?
The settlement administrator will mail payments to eligible class members approximately 58 days after the court grants final approval of the settlement.
Why was there a class action settlement?
The class action lawsuit alleged that Safeway, Albertsons, Costco and Advantage failed to provide required meal and rest breaks, all wages owed and accurate wage statements and violated other California labor laws.
The defendants denied all allegations but agreed to settle to avoid the uncertainty and expense of continued litigation and a possible trial.
