
Consumers who purchased RevitaLash Advanced Eyelash Conditioner, RevitaLash Advanced Sensitive Eyelash Conditioner, RevitaLash Advanced Pro Eyelash Conditioner or RevitaBrow Advanced Eyebrow Conditioner in the United States between Jan. 1, 2017, and Dec. 29, 2025, may be eligible to claim a cash payment and/or a product voucher from a class action settlement.
Athena Cosmetics Inc. agreed to pay $4.17 million to settle a class action lawsuit alleging violations related to the marketing and sale of its RevitaLash and RevitaBrow products. The plaintiffs claimed Athena failed to disclose material information about the products, including potential risks and side effects of an ingredient.
Who can file a claim?
Class members must meet the following criteria:
- They purchased any formulation of RevitaLash Advanced Eyelash Conditioner, RevitaLash Advanced Sensitive Eyelash Conditioner, RevitaLash Advanced Pro Eyelash Conditioner or RevitaBrow Advanced Eyebrow Conditioner in the United States.
- They made the purchase between Jan. 1, 2017, and Dec. 29, 2025.
- They bought the product for personal, family or household use (not for resale).
Additional details:
- Class members could have purchased the products directly from Athena or from other retailers.
- The settlement includes all varieties and formulations of the listed products.
- Class members who appear in Athena's records or can provide proof of purchase may submit a claim for each product purchased.
- Those who do not have proof of purchase can claim one product per household.
How much can class members receive?
The settlement provides two main types of awards: a cash payment and/or a product voucher. The total settlement fund is $4.17 million, which the settlement divides into a $3,036,000 cash fund and a $1,134,000 voucher fund.
There are two main categories of claimants:
- Those with proof of purchase: Eligible to submit a claim for each purchased product and may receive both a cash payment and a voucher
- Those without proof of purchase: Limited to one claim per household and may claim either a cash payment or a voucher
Cash benefit: The exact amount will depend on the number of valid claims submitted. The settlement administrator will distribute the fund on a pro rata basis after deducting attorneys’ fees, costs, service awards and administration expenses.
Voucher: A non-expiring voucher code worth $110 and redeemable for any product on Athena’s website
If the total value of claimed vouchers exceeds $1,134,000, the administrator will require proof of purchase for all vouchers. If the voucher fund is still insufficient, the administrator will use the cash fund for vouchers on a dollar-for-dollar basis as long as no individual cash benefit drops below $20.
How to claim a settlement payout
Class members can submit the online claim form or download, print and mail the PDF claim form to the settlement administrator. The claim deadline is April 20, 2026.

Required proof and documentation
The settlement requires proof of purchase to submit a claim for more than one product or to claim both a cash benefit and a voucher. Those without proof may claim only one benefit per household by attesting to their purchase. Acceptable proof includes receipts, order confirmations, shipping confirmations or purchase history documentation.

$4.17 million settlement fund
The $4,170,000 settlement fund includes a $3,036,000 cash fund and a $1,134,000 voucher fund. The breakdown includes:

- Attorneys' fees: To be determined
- Attorneys' expenses: To be determined
- Service awards to class representatives: Up to $10,000 each (up to $20,000)
- Payments to eligible class members: Remainder of the fund
The settlement administrator will donate any unclaimed funds after distribution to City of Hope.

When is the eye serum settlement payout date?
The settlement administrator will issue payments to eligible class members approximately 21 days after the court resolves any appeals and grants final approval to the settlement.
Why is there a class action settlement?
The class action lawsuit alleged that Athena Cosmetics Inc. failed to disclose material information about its RevitaLash and RevitaBrow products, including the potential risks and side effects of an ingredient.
Athena denied all allegations. The parties agreed to settle to avoid the expense, risk and uncertainty of continued litigation.
