Individuals who received notice that the February 2025 Tempel Steel Co. LLC data breach may have compromised their personal information could be eligible to claim up to $5,000 plus credit monitoring from a class action settlement.

Tempel Steel Co. LLC agreed to pay $175,000 to settle a class action lawsuit alleging it failed to adequately safeguard personal information during a cyberattack that occurred in February 2025. The potentially compromised information may have included names, addresses, Social Security numbers, tax identification numbers, dates of birth, health insurance and health information, driver’s license or state-issued identification card numbers, and financial account information.

Who can file a claim?

The settlement class includes:

  • All individuals residing in the United States whose personal information the February 2025 security incident involving Tempel Steel Company LLC potentially compromised
  • All individuals who received notice of the security incident from Tempel Steel or the settlement administrator

The estimated number of class members is approximately 5,192.

How much can class members get?

Class members can claim several types of awards, depending on their circumstances and the losses they experienced as a result of the data breach:

  • Ordinary expenses: Class members who incurred actual, documented out-of-pocket expenses due to the security incident can receive reimbursement up to $1,000. Covered expenses include fees for credit reports or monitoring, costs to replace IDs and postage to contact banks. Proof, such as receipts, is required.
    • Compensation for lost time: Those who spent time responding to the incident can claim up to four hours at $20 per hour for a maximum of $80. Lost-time claims are subject to the $1,000 cap for ordinary expenses.
  • Extraordinary Expenses: Class members who lost money due to identity theft or fraud the data breach likely caused can claim up to $4,000. Proof of loss and a connection to the security incident are required.
  • Alternative cash payment: Instead of ordinary or extraordinary expenses, class members may claim a one-time $25 payment, which does not require proof.
  • Credit monitoring services: All class members are eligible to enroll in two years of CyEx Identity Defense Total, which includes $1 million in identity theft insurance, real-time credit file monitoring, dark web scanning and public records monitoring.

How to claim a class action payment

Class members can file the online claim form or download, print and complete the PDF claim form and mail or email it to the settlement administrator. The claim deadline is April 6, 2026.

What proof or information is required to submit a claim?

  • To file an online claim, class members must log in with the unique ID and PIN from the settlement notice they received. Those who are unable to locate their ID and PIN should contact the settlement administrator by emailing info@TempelDataSettlement.com and providing their full name and mailing address. The PDF claim form does not require the unique ID or PIN.
  • To file an ordinary expenses claim, class members must provide receipts or other proof of out-of-pocket costs.
  • To file an extraordinary expenses claim, class members must provide receipts, bank statements or other proof of loss and a connection to the breach.
  • To file a lost time claim, class members must provide a description of the time spent.
  • To file an alternative cash payment claim, no documentation required.

Payout options

  • Those who submit a claim online can choose to receive payment digitally via PayPal, Venmo or Zelle.
  • Those who submit a claim by mail will receive a paper check at the address they provide.

When is the Tempel Steel data breach settlement payout date?

The settlement administrator will distribute payments after the court resolves any appeals and grants final approval of the settlement.

Why is there a class action settlement?

The class action lawsuit alleged Tempel Steel failed to adequately protect personal information, resulting in potential unauthorized access to sensitive data during a targeted cyberattack on Tempel Steel’s computer systems in February 2025.

Tempel Steel denies any wrongdoing but agreed to settle to avoid the costs, risks and uncertainties of further litigation.
