Mercedes-Benz $2.8M Emissions Parts Class Action Settlement

Individuals who paid out of pocket to diagnose, repair or replace certain emissions-related parts on a model year 2015 or newer Mercedes-Benz vehicle between four years/50,000 miles and seven years/70,000 miles may be eligible to claim up to 100% reimbursement from a class action settlement.

Mercedes-Benz USA LLC agreed to settle a class action lawsuit for allegedly failing to identify and cover specific emissions-related parts as required under California’s emissions warranty regulations.

Who can file a claim?

Class members must meet all of the following criteria:

  • They owned or leased a Mercedes-Benz vehicle (model year 2015 or newer) registered in one of the following states during the relevant period:
    • California
    • Colorado
    • Connecticut
    • Delaware
    • Maine
    • Maryland
    • Massachusetts
    • Minnesota
    • Nevada
    • New Jersey
    • New York
    • Oregon
    • Pennsylvania
    • Rhode Island
    • Vermont
    • Virginia
    • Washington
  • The “HPP warranty” from Mercedes-Benz USA covered their vehicle. The warranty applies to high-priced, emissions-related parts between four years/50,000 miles and seven years/70,000 miles (excluding electric vehicles).
  • They paid out of pocket for the diagnosis, repair or replacement of any of the following “subject parts” between four years/50,000 miles and seven years/70,000 miles:
    • Manifold PCV connection assembly
    • Power train control unit (PCM)
    • Accelerator pedal sensor
    • Accelerator pedal
    • Partial load operation crankcase ventilation valve
    • Clean air line
    • Pressure sensor downstream of air filter
    • Check valve within the EVAP system
    • Crankcase ventilation system
    • Vent control valve
    • Charcoal canister
    • Fuel tank level indicator fill level sensors
    • Coolant thermostat
    • ESP control unit
  • Their payment for diagnosis, repair or replacement occurred between four years/50,000 miles and seven years/70,000 miles.

The model year coverage start date varies by state:

  • For California, Connecticut, Delaware, Maine, Maryland, Massachusetts, New Jersey, New York, Oregon, Pennsylvania, Rhode Island, Vermont and Washington, coverage starts with model year 2015.
  • For Colorado, coverage starts with model year 2022.
  • For Minnesota, Nevada and Virginia, coverage starts with model year 2025.

How much can class members get?

There are two main categories of reimbursement:

  • Qualified repair reimbursement: Consumers who paid for a repair or replacement of a covered part after their vehicle’s four-year/50,000-mile warranty expired but before the seven-year/70,000-mile warranty expired can claim 50% of their out-of-pocket costs (including parts, labor and diagnosis).
  • Qualified diagnosis reimbursement: Consumers who paid for a diagnosis of a covered part during the same period but did not proceed with a repair or replacement can claim 100% of their out-of-pocket costs for the diagnosis.

Additionally, after the settlement’s effective date, Mercedes-Benz USA will provide 100% coverage for the repair, replacement or diagnosis of these parts at authorized service centers for eligible vehicles within the seven-year/70,000-mile period.

Consumers who did not incur any out-of-pocket costs for a qualified repair or diagnosis before the effective date of the settlement will not be eligible for reimbursement. However, they may still benefit from the settlement’s forward-looking warranty coverage for the subject parts.

How to claim a Mercedes-Benz payout

Class members can submit the online claim form or download, print and complete the PDF claim form to mail or email to the settlement administrator.

Class members claiming repairs or diagnoses that occurred before the notice date (March 16, 2026) must submit a claim by May 15, 2026. Class members claiming repairs or diagnoses after the notice date but before the effective date must submit a claim within 60 days of the service date.

What proof or documentation is required to submit a claim?

  • An itemized repair order, invoice or other documentation showing the subject vehicle received a qualified repair or diagnosis (the documentation must show the subject part repair, replacement or diagnosis and the cost)
  • Proof of payment for the qualified repair or diagnosis (such as a credit card statement, invoice showing a zero balance or receipt)
  • Proof of ownership or lease of the vehicle at the time of the repair or diagnosis
  • Proof of registration in a covered state at the time of the repair or diagnosis

Payout options

  • Electronic payment
  • Paper check mailed to the address provided on the claim form

Settlement fund breakdown

The settlement fund will cover:

  • Attorneys' fees and costs: Up to $2,812,500
    • Settlement administration costs: To be determined (paid from the $2,812,500 award for attorneys' fees and costs)
    • Service award to class representative: Up to $10,000 (paid from the $2,812,500 award for attorneys' fees and costs)
  • Payments to class members: Reimbursement for valid claims

When is the Hazdovac v. Mercedes-Benz USA LLC payout date?

The settlement administrator will issue payments within 30 days of the final decision regarding the claim.

Why is there a class action settlement?

This lawsuit alleged Mercedes-Benz USA LLC failed to identify and cover 14 emissions-related parts as “high-priced parts” under California’s emissions warranty regulations. The plaintiff claimed the automaker should have covered these parts for seven years/70,000 miles but did not provide the required coverage.

Mercedes-Benz USA denies any wrongdoing but agreed to settle to avoid further litigation costs and uncertainty.
