Individuals who received notice that a January 2024 Mason Construction LLC data breach affected their private information may be eligible to claim up to $5,575 from a class action settlement.

Mason Construction LLC agreed to resolve a class action lawsuit alleging it failed to adequately protect personal information during a cyberattack in January 2024. The lawsuit claimed an unauthorized user accessed files containing sensitive data, including names, Social Security numbers, driver’s license numbers, financial information and medical and health insurance details.

Who can file a claim?

Class members must meet the following criteria:

  • They reside in the United States.
  • The data incident Mason Construction discovered in January 2024 impacted their private information.
  • They received notice of the data incident from Mason Construction.

How much can class members get?

The settlement provides several options for compensation, depending on the class member's circumstances and the data breach's impact on them:

  • Ordinary losses: Up to $500 for documented out-of-pocket expenses related to the data incident. Covered expenses include fees for credit reports, credit monitoring, freezing/unfreezing credit and replacing IDs and and postage to contact banks. Class members must provide proof, such as receipts.
  • Extraordinary losses: Up to $5,000 for losses due to identity theft or fraud provided the class member can show the data incident likely caused the loss and no other third party reimbursed. Class members must provide documentation and evidence linking the loss to the incident.
  • Lost time: Up to three hours at $25 per hour (maximum $75) for time spent responding to the data incident, such as changing passwords or investigating suspicious account activity. Class members must describe their activities and check an attestation box.
  • Alternative cash payment: A one-time $55 cash payment available without documentation or explanation. Class members cannot claim this payment if they also claim reimbursement for losses or lost time.
  • Credit monitoring services: All class members are eligible for two years of CyEx Identity Defense Complete, which includes $1 million in identity theft insurance, real-time credit file monitoring, dark web scanning and public records monitoring. If the program detects suspicious activity, the package includes a fraud resolution agent.

How to claim a class action settlement payment

Class members can file a claim online or print and complete the PDF claim form and mail or email it to the settlement administrator.

  • To file a lost time claim, class members must briefly describe their activities and check an attestation box.
  • To file an alternative cash payment, class members must check an attestation box.
