If you were a patient or employee of a Synergy Healthcare Services, Inc.-managed facility in the United States whose personal information may have been affected by the November 2022 data breach, you may be eligible to claim up to $10,000 from a class action settlement.

Pourlessoins, LLC, doing business as Synergy Healthcare Services, has agreed to pay to settle a class action lawsuit. The lawsuit alleged that Synergy failed to adequately protect sensitive personal and health information, resulting in a data security incident that exposed confidential details of patients and employees.

Who is eligible for a settlement payout?

Class members must meet the following criteria:

  • You are a current or former employee or patient of a Synergy Healthcare Services, Inc.-managed facility in the United States.
  • Your personal information was involved in the data security incident that occurred around November 30, 2022.
  • You received a notice from Synergy about the data breach in or around July 2023.

How much is the data breach class action payment?

Class members have these claim options:

  • Ordinary Losses: You can submit for up to $1,000 in reimbursement for out-of-pocket expenses.. Eligible expenses include:
    • Bank fees
    • Postage or gasoline for local travel
    • Fees for credit reports, credit monitoring, or identity theft insurance purchased between November 30, 2022, and July 24, 2025, if the product offered greater protection or a longer term than the credit monitoring previously offered by Synergy
  • Lost Time: Class members can claim up to four hours of time lost spent dealing with the data breach, at $20 per hour, for a total of $80.
  • Extraordinary Losses: You can submit for reimbursement up to $10,000 for documented, unreimbursed monetary loss due to actual identity theft traceable to the data incident. Losses must have occurred between November 30, 2022, and July 24, 2025.
  • Credit Monitoring: If you did not enroll in the credit monitoring offered in Synergy’s original notice, you can claim two years of single-bureau credit monitoring. If you did enroll, you can claim one additional year. This benefit is available even if you do not claim reimbursement for expenses.

How to claim a data breach payout

To receive a class action rebate, class members must submit a valid claim form by the July 24, 2025 deadline. You can file a claim online or download and print a PDF claim form to mail to the settlement administrator.

What proof or information is required to submit a claim?

  • Unique ID and PIN from court-ordered settlement notice required to submit a claim.
  • Ordinary Losses claims require supporting documentation such as receipts, bank statements, phone bills, or other documents showing expenses you incurred due to the data breach.
  • Extraordinary Losses claims require proof including detailed documentation of the fraud, financial loss, and proof that identity theft took place.

Data breach settlement fund breakdown

The settlement fund will include the following costs:

  • Settlement administration costs: To be determined
  • Attorneys' fees and costs: Up to $300,000
  • Service awards to class representatives: $2,500 each, a total of $7,500
  • Credit monitoring: Cost determined by the number of claims filed
  • Payments to class members: Amount determined by the number of approved claims

When is the Synergy data breach settlement payout date?

The final approval hearing is scheduled for August 12, 2025. According to the settlement agreement payments to approved claimants will be issued approximately 90 days after the judge grants approval or within 30 days of the date claim processing is complete.

Why did this class action settlement happen?

The class action lawsuit was filed after a data security incident in November 2022 exposed sensitive information of Synergy Healthcare Services patients and employees. Plaintiffs claimed Synergy was negligent in protecting this data, failed to fulfill contractual obligations, and was unjustly enriched.

Synergy denies these allegations but agreed to settle to avoid the risks and expense of continued litigation.
