Summerville, Ga., residents who paid for city water service between January 2020 and March 5, 2025, may qualify to claim free bottled water delivery or a permanent water filtration system from a class action settlement.

Pulcra Chemicals LLC, Huntsman International LLC, Mount Vernon Mills Inc. and the Town of Trion, Ga., agreed to contribute to a settlement fund to resolve allegations that their actions led to per- and polyfluoroalkyl substance contamination in Summerville’s drinking water.

Who can claim a Summerville payout?

Class members must meet the following criteria:

  • They must be a current account holder, ratepayer or user of water and/or sewer service from the City of Summerville, Ga. This includes all residential, commercial and industrial ratepayers.
  • All adult individuals residing at a residence that receives water or sewer service from Summerville are included.
  • For the Pulcra Chemicals LLC settlement, residents must have used and paid for Summerville water between January 2020 and Jan. 23, 2025.
  • For the Huntsman International LLC, Mount Vernon Mills Inc. and Town of Trion, Ga., settlements, residents must have used and paid for Summerville water between Jan. 1, 2020, and March 5, 2025.
  • Only one claim form should be submitted per property.
  • Renters can participate.

How is much is the PFAS water payment?

Class members have the option to receive one of two benefits:

  • Permanent water filtration system: Eligible properties may receive a permanent in-home water filter installed by Fontis Water Incorporated. This installation may require modifications to the property, such as drilling into countertops. Renters must obtain landlord approval for this option.
  • Bottled water delivery: Eligible properties may receive 5-gallon jugs of PFAS-free spring water delivered to their home or business.

The number of filters installed and the duration of bottled water delivery will depend on the number of eligible claimants and the total funds available.

Class members can file a claim online or download, print and complete the PDF claim form then mail or email it to the settlement administrator.

Information and documentation required

  • Claimants must provide their Social Security number.
  • Renters must provide their landlord’s contact information and signature if selecting the filter option.

$1 million drinking water settlement fund

The $1,000,000 settlement fund covers:

  • Settlement administration costs: To be determined
  • Attorneys' fees and expenses: Up to $250,000
  • Service awards to class representatives: To be determined
  • Benefits to eligible class members: Value of water filters and bottled water delivery

Why is there a class action settlement?

The class action lawsuit alleges Pulcra Chemicals LLC, Huntsman International LLC, Mount Vernon Mills Inc. and the Town of Trion, Ga., contaminated Summerville’s drinking water supply with PFAS chemicals.

The companies deny any wrongdoing but agreed to settle to avoid further litigation and provide immediate relief to water users.
