Individuals who received notice that the February 2024 SouthState Bank data breach impacted their private information may be eligible to claim up to $3,500 plus other benefits from a class action settlement.

SouthState Bank NA agreed to settle a class action lawsuit for alleged negligence, breach of contract, breach of fiduciary duty and unjust enrichment related to a data incident that exposed sensitive customer information.

Who can file a claim?

Class members may file a claim if all of the following apply:

  • They reside in the United States.
  • They received a notice stating the data incident that occurred on or around Feb. 7, 2024, impacted their private information. SouthState Bank began notifying affected individuals on March 29, 2024.

The data incident potentially exposed the following types of private information:

  • Names
  • Dates of birth
  • Addresses
  • Telephone numbers
  • Financial account numbers
  • Social Security numbers

How much can class members get?

The settlement provides two types of cash payments, as well as free credit monitoring for all class members who do not opt out.

  • Documented losses (cash payment A): Class members can receive up to $3,500 for actual, documented monetary losses incurred after Feb. 7, 2024. Class members cannot receive reimbursement for losses another source already reimbursed, including compensation from credit monitoring or identity theft protection products. Eligible losses include:
    • Bank fees, overdraft charges, late fees or declined payment fees due to fraud
    • Charges for credit monitoring or identity theft protection purchased in response to the breach
    • Costs to place or remove a credit freeze
    • Professional fees to address identity fraud (such as fees for accountants, attorneys or fraud specialists)
    • Replacement costs for government-issued identification or documents
    • Long-distance phone charges, postage, notary or similar incidental costs
    • Fraudulent, unreimbursed charges or financial loss directly traceable to misuse of personal information from the breach
  • Pro rata cash payment (cash payment B): After the settlement administrator pays all valid claims for documented losses, it will divide the remaining balance of the $1,500,000 fund among all valid claimants who request this benefit. The exact amount will depend on the number of claims and the total amount remaining in the settlement fund.
  • Credit monitoring: All class members who do not opt out will receive one year of credit monitoring with one credit bureau, including $1,000,000 in identity theft insurance. This benefit is automatic and does not require a claim form.

If the total amount of valid claims exceeds the available settlement fund, the settlement administrator will reduce payments proportionally.

How to claim a settlement payment

Class members can file a claim online or download and print a PDF claim form to complete and mail to the settlement administrator. The claim deadline is June 15, 2026.

Is proof or documentation required to submit a claim?

  • For documented losses (cash payment A), class members must provide reasonable documentation generated by a third party. The settlement does not consider personal certifications, declarations or affidavits proper documentation, but class members may include them to provide clarification or context. Reasonable documentation may include:
    • Credit card statements
    • Bank statements
    • Invoices
    • Telephone records
    • Receipts
  • For the pro rata cash payment (cash payment B), class members do not need to provide documentation but must still submit a claim form.
  • For credit monitoring, class members do not need to provide documentation or submit claim form.
  • For online claims, class members must provide the settlement class member ID and PIN located on the settlement notice they received. Those who do not have this information can contact the settlement administrator at 888-232-0977 for assistance.

Payout options

  • If class members file online, they may choose electronic payment.
  • If class members file by mail, the settlement administrator will send a check to the address on file.

The settlement fund includes:

  • Settlement administration costs: Amount not specified
  • Attorneys’ fees and costs: Up to $1,750,000
  • Service awards to class representatives: $1,500 total
  • Credit monitoring costs: Cost determined by number of class members who claim this benefit
  • Payments to eligible class members: Up to $1.5 million

When is the SouthState Bank data incident settlement payout date?

The settlement administrator will distribute payments after the court resolves any appeals and grants final approval of the settlement.

Why did this class action settlement happen?

The class action lawsuit alleged SouthState Bank experienced a data breach in February 2024 when a third party unlawfully accessed the bank’s computer network and obtained the private information of current and former customers. The plaintiffs claimed the bank failed to implement proper cybersecurity protocols, resulting in negligence, breach of contract, breach of fiduciary duty and unjust enrichment.

SouthState Bank denied all wrongdoing but agreed to settle to avoid the costs and risks of litigation and provide benefits to affected individuals.
