Consumers who received a notice from PurFoods LLC informing them their personal information may have been compromised as a result of a data incident may qualify to claim up to $5,000 from a class action settlement.

PurFoods LLC agreed to pay $4.25 million to resolve a class action lawsuit alleging it failed to adequately protect the personal data of its customers, employees and independent contractors, resulting in a cyberattack that occurred between Jan. 16, 2023, and Feb. 22, 2023.

Who can file a PurFoods claim?

Class members must meet all of the following criteria:

  • They are a resident of the United States.
  • They received a notice from PurFoods LLC in August or September 2023 stating their personal information may have been accessed, stolen or compromised as a result of the data incident.

The affected class includes customers, employees and independent contractors and includes approximately 1,249,219 individuals.

How much can class members get?

  • Documented loss payment: Up to $5,000 per person for documented, unreimbursed losses related to the data incident. This includes out-of-pocket expenses, such as:
    • Unreimbursed losses from fraud or identity theft
    • Professional fees (attorneys, accountants, credit repair services, etc.)
    • Costs to freeze or unfreeze credit with any credit reporting agency
    • Unreimbursed bank fees
    • Postage
    • Gasoline for local travel
  • Cash award: Class members who do not have documented losses may claim a pro rata cash payment from the remaining settlement fund after other expenses are paid. The estimated cash award is about $75, but the actual amount may be higher or lower depending on the number and value of claims submitted. The cash award will not exceed $5,000 per person.
  • Credit monitoring and insurance services: All class members who submit a valid claim form can elect to receive three years of three-bureau credit monitoring and $1,000,000 in identity theft insurance at no cost regardless of whether they claim a cash award or documented loss payment.

How to claim a data breach payment

Class members can submit the online claim form or download, print and complete the PDF claim form and mail it to the settlement administrator. The claim deadline is Oct. 30, 2025.

Is proof/documentation required to submit a claim?

  • All class members must provide the class member ID located on their settlement notice.
  • For documented loss payment claims, class members must provide receipts or other non-self-prepared documentation showing the loss and its connection to the data incident. Handwritten receipts by themselves are not sufficient but may be used to support other documents.
  • For the cash award or credit monitoring, class members only need to select the appropriate option.

$4.25 million settlement fund breakdown

The $4,250,000 settlement fund includes:

  • Settlement administration costs: $510,000
  • Attorneys' fees: $1,416,525
  • Attorneys' costs: To be determined
  • Service awards to class representatives: Up to $2,500 each
  • Credit monitoring costs: Determined by number of claims
  • Payments to eligible class members: The remainder of the fund

Important dates

  • Opt-out deadline: Sept. 30, 2025
  • Deadline to file a claim: Oct. 30, 2025
  • Final approval hearing: Nov. 20, 2025

When is the PurFoods LLC data incident payout date?

The settlement administrator will issue payments approximately 30 days after the court grants final approval to the settlement and resolves any appeals.

Why is there a class action settlement?

The class action lawsuit alleged PurFoods LLC experienced a cyberattack that potentially compromised the personal information of more than 1.2 million individuals. The plaintiffs claimed PurFoods failed to adequately protect this information, resulting in potential harm to those affected.

PurFoods denies any wrongdoing but agreed to settle to avoid the time, expense and uncertainty of further litigation.
