
Adults in the United States whose personal or protected health information the September 2024 Physicians' Primary Care of Southwest Florida data breach may have compromised could be eligible to submit a claim for up to $5,000 and/or credit monitoring from a class action settlement.
Physicians' Primary Care of Southwest Florida P.L. agreed to pay to settle a class action lawsuit alleging it failed to adequately protect private information during a targeted cyberattack in September 2024. The cybersecurity incident impacted current and former patients and other individuals.
Who can file a claim for a data breach payout?
Class members are adults residing in the United States whose private information the Physicians' Primary Care of Southwest Florida data breach that occurred in September 2024 may have been impacted, including those who received notice of the incident.
How much are settlement payments?
Class members have the following benefit options:
- Cash payment for documented losses: Class members can claim up to $5,000 for documented out-of-pocket losses that occurred between Sept. 17, 2024, and Sept. 29, 2026, and are traceable to the data breach. Eligible expenses include monetary losses due to identity theft and fraud; fees for credit reports, credit monitoring or freezing/unfreezing credit; costs to replace IDs; and postage to contact financial institutions.
- Medical data monitoring: All class members can elect to receive two years of CyEx Medical Shield Complete, which includes $1 million in medical identity theft insurance; monitoring for health care insurance ID exposure, medical record number exposure and unauthorized health savings account spending; and access to a fraud resolution agent (if needed).

To receive a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

- Online claims require the unique ID and PIN from the official settlement notice the class member received.
- Documented losses claims require supporting documentation, which may include receipts, invoices, bank or credit card statements showing unreimbursed fees or fraudulent charges, or other proof of identity theft or fraud.

When is the Physicians Primary Care data breach settlement payout date?
The settlement administrator will issue payments to approved claimants no later than 105 days after the court grants final approval of the settlement.
Why is there a class action settlement?
This class action lawsuit claimed a targeted cyberattack on Physicians' Primary Care’s computer systems in September 2024 compromised personal and protected health information. The plaintiffs alleged Physicians' Primary Care failed to adequately protect this sensitive data.
The company denies the allegations but agreed to settle to avoid the expense and risk of continued litigation.
