
Current and former employees and customers who received a notice that the Nice-Pak Products cybersecurity incident that occurred in May and June 2023 may have compromised their private information could be eligible to submit a claim for up to $5,040 from a class action settlement. The settlement class includes approximately 8,500 individuals.
Nice-Pak Products Inc. and Professional Disposables International Inc. agreed to settle a class action lawsuit alleging cybercriminals accessed their systems between May 28, 2023, and June 15, 2023. The plaintiffs claimed the companies failed to adequately protect sensitive personal information, including names, Social Security numbers, financial account data and medical information.
Who can file a claim for a data breach payout?
Class members are individuals who received notification that the May and June 2023 Nice-Pak data breach potentially compromised their private information.
How much will settlement payments be?
Class members have the following benefit options:
- Ordinary out-of-pocket expenses: Class members can claim up to $450 in ordinary out-of-pocket expenses, which may include fees for freezing and unfreezing credit, credit monitoring costs, professional fees, such as attorneys' or accountants' fees, and any other miscellaneous costs. Expenses over $50 require documentation.
- Extraordinary out-of-pocket expenses: Class members can claim up to $4,500 in documented losses that occurred due to identity theft or fraud caused by the data breach.
- Lost time reimbursement: Class members may claim up to four hours of lost time spent responding to the data breach at $22.50 per hour for a maximum of $90.
- Credit monitoring and identity theft protection: All class members can elect to enroll in three years of Privacy Shield Pro, which includes features such as a dark web watchlist, VPN, private search, password defense, digital vault and data broker opt-out services.
How to claim a class action rebate
To receive a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

- Ordinary expenses claims over $50 require supporting documentation, which may include receipts and invoices.

When is the Nice-Pak data breach settlement payout date?
The settlement administrator will issue payments to approved claimants approximately 60 days after it completes claim processing or the court grants final approval of the settlement, whichever is later.
