Current and former employees and customers who received a notice that their private information may have been compromised in the Nice-Pak Products cybersecurity incident that occurred in May and June 2023, may be eligible to submit a claim for up to $4,500 from a class action settlement. The settlement class includes approximately 8,500 individuals.

Nice-Pak Products Inc. and Professional Disposables International Inc. have agreed to pay to settle a class action lawsuit. The plaintiffs claimed that the companies failed to adequately protect sensitive personal information, including names, Social Security numbers, financial account data and medical information, when cybercriminals accessed their systems between May 28, 2023, and June 15, 2023.

Who can file a claim for a data breach payout?

Class members are individuals who received notification that their private information was potentially compromised in the May and June 2023 Nice-Pak data breach.

How much will settlement payments be?

Class members have the following benefit options:

  • Ordinary out-of-pocket expenses: Class members can claim up to $450 in ordinary out-of-pocket expenses, which may include fees for freezing and unfreezing credit, credit monitoring costs, professional fees, such as attorneys' or accountants' fees and any other miscellaneous costs. Expenses totaling over $50 require documentation.
  • Extraordinary out-of-pocket expenses: Class members can claim up to $4,500 in documented losses that occurred due to identity theft or fraud caused by the data breach.
  • Lost time reimbursement: Class members may claim up to four hours of lost time spent responding to the data breach, at $22.50 per hour, a maximum of $90.
  • Credit monitoring and identity theft protection: All class members can elect to enroll in three years of Privacy Shield Pro, which includes features such as a dark web watchlist, VPN, private search, password defense, digital vault and data broker opt-out services.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print the PDF claim form to mail to the settlement administrator.

Required proof and claim information

  • Unique ID and PIN from settlement notice required to submit a claim online.
  • Ordinary expenses claims over $50 require supporting documentation which may include receipts and invoices.
  • Extraordinary expenses claims require supporting documentation such as bank or credit card statements showing unreimbursed fraudulent charges, police report and other proof of fraud or identity theft directly related to the data breach.

Data breach settlement fund

The settlement fund will include

  • Settlement administration costs: To be determined
  • Attorneys’ fees and expenses: up to $200,000
  • Service awards to class representatives: Up to $5,000 each
  • Privacy Shield Pro: Cost determined by number of claims filed
  • Cash payments to claimants: Total of all approved claims

When is the Nice-Pak data breach settlement payout date?

Payments will be issued to approved claimants approximately 60 days after the court grants final approval of the settlement or claim processing is completed, whichever is later.

Why was there a class action settlement?

The class action lawsuit was filed because Nice-Pak Products Inc. and Professional Disposables International Inc. experienced a cybersecurity incident that potentially exposed sensitive personal information. Plaintiffs alleged that the companies failed to adequately protect this information, resulting in claims of negligence, negligence per se and breach of implied contract.

The companies deny any wrongdoing but agreed to settle to avoid the risk and expense of continued litigation.
