Consumers who purchased a new Passport Western edition trailer from a Keystone-authorized dealership in California before Dec. 1, 2019, and with a serial number ending after HX414101 may be eligible to claim $2,000 per trailer from a class action settlement.

Keystone RV Co. agreed to pay $3.11 million to resolve a class action lawsuit alleging it misrepresented the construction of certain Passport Western edition trailers. Specifically, the lawsuit claimed Keystone advertised these trailers as having steel roof trusses when some had wood roof trusses.

Who can file a claim?

Class members must meet all of the following criteria:

  • They purchased a new Passport Western edition trailer from a Keystone-authorized dealership in California.
  • The purchase occurred before Dec. 1, 2019.
  • The trailer’s serial number sequentially ends after HX414101.
  • They currently own the trailer.
  • The trailer has wood roof trusses (not metal).

The settlement administrator identified class members based on Keystone’s sales records. Consumers who received a notice about the settlement likely have a trailer that meets the initial criteria; however, they must confirm the construction of their trailer’s roof trusses to be eligible for payment.

Class members who own more than one qualifying trailer must submit a separate claim for each.

How much can class members get?

The total settlement fund is $3,107,000. This amount should cover up to 541 class members at $2,000 each plus attorneys’ fees and costs, settlement administration costs, a service award for the lead plaintiff and other costs.

How to claim a class action settlement payment

What proof or documentation is required to submit a claim?

Class members must provide proof that they currently own the qualifying trailer. Acceptable documentation includes:

  • Current vehicle registration
  • Certificate of title
  • DMV records
  • Proof of current insurance

Additionally, class members must confirm their trailer has wood roof trusses. They can do this by removing screws from a vent in the bathroom and visually inspecting the trusses. If Keystone disputes their claim, they may need to provide photographs or video showing the wood trusses.

Payout options

The settlement administrator will mail checks to the address class members provide on their claim form.

$3.11 million settlement fund breakdown

The $3,107,000 settlement fund will cover:

  • Attorneys’ fees and costs: $2,000,000
  • Service award to class representative: $25,000
  • Solar panel installation for lead plaintiff’s trailer: Value not specified
  • Payments to class members: Up to $2,000 per qualifying trailer (maximum of 541 class members)

Class members must cash their checks within 90 days. If they do not, Keystone will retain the funds.

Why did this class action settlement happen?

The class action lawsuit alleged Keystone manufactured Passport brand Western edition trailers with wood roof trusses but advertised them as having steel roof trusses. The plaintiffs claimed that misrepresentation violated several California consumer protection laws, including the California Consumers Legal Remedies Act, the California Unfair Competition Law and the California False Advertising Law, as well as common law unjust enrichment.

Keystone denied all allegations but agreed to settle to avoid further litigation and expense.
