Nonexempt hourly employees who worked for Jennmar Corp. or its related entities at its Virginia manufacturing facilities between April 12, 2016, and Feb. 10, 2026, may be eligible to claim a cash payment from a class action settlement.

Jennmar Corp. agreed to pay $3,000,000 to resolve a class action lawsuit claiming it failed to properly compensate certain nonexempt hourly employees for all hours worked. The claims include allegations of unpaid pre- and post-shift work and timekeeping practices resulting in unpaid wages.

Who are the class members?

Class members are included in the settlement if they meet the criteria for one or more of the following groups:

  • Virginia wage class: Anyone who worked for Jennmar or related entities in Virginia as a nonexempt hourly employee at any time from April 12, 2018, through Feb. 10, 2026, and whose employment fits the class definition approved by the court
  • Breach of contract class: Anyone who worked for Jennmar or related entities in Virginia as a nonexempt hourly employee at any time from April 12, 2016, through Feb. 10, 2026, and whose employment fits the class definition approved by the court
  • FLSA class: Anyone who previously filed a written consent to join this lawsuit under the Fair Labor Standards Act

The settlement administrator will base class membership on Jennmar’s payroll and timekeeping records.

How much can class members get?

The total settlement fund is $3,000,000. After deductions for attorneys’ fees, litigation costs, service awards and administration costs, the net settlement amount available for class members is approximately $1,705,844.49. The settlement divides the fund as follows:

  • Virginia wage class fund: $1,446,842.20
  • Breach of contract class fund: $200,986.25
  • FLSA class fund: $58,016.04

Each eligible class member will receive a pro rata share of the relevant fund(s) based on Jennmar’s payroll and timekeeping records and the allocation plan the court approves. This means payment depends on the class member's employment history and the total number of eligible class members in their group.

Class members in more than one class may receive payments from multiple funds.

No action needed to receive payment

Eligible class members do not need to file a claim to receive payment. Those included in the settlement who do not opt out will automatically receive their payment after court approval. There is no online claim form or downloadable PDF claim form required for this settlement.

However, class members whose address has changed should promptly notify the settlement administrator to ensure they receive payment.

Payout options

The settlement administrator will split each class member's payment into two checks: one for wages (subject to payroll taxes) and one for nonwage compensation (not subject to payroll taxes). Checks will expire 150 days after the effective date of the settlement.

$3 million settlement fund breakdown

The $3,000,000 settlement fund will cover:

  • Settlement administration costs: Up to $35,000
  • Attorneys’ fees: $1,000,000
  • Attorneys’ expenses: $209,155.51
  • Service awards to class representatives: $25,000 each ($50,000 total)
  • Payments to eligible class members: $1,705,844.49 (estimated)

When is the Jennmar wage settlement payout date?

If the court approves the settlement at the final approval hearing, the settlement administrator will mail payments after the settlement becomes effective.

Why is there a class action settlement?

The class action lawsuit alleged Jennmar and related entities failed to pay nonexempt hourly employees for all compensable time worked, including pre- and post-shift work and time lost due to timekeeping practices.

Jennmar denied all liability but agreed to settle to avoid the cost, risk and delay of trial.
